against the public interest immunity aspect of the primary judge's order. That leave application, together with the whole of the judicial review application, was heard by a Full Court of the Federal Court.Other than challenging the primary judge's treatment of the question of public interest immunity, the only ground of review ultimately pressed by the applicant alleged that there had been a denial of procedural fairness in ASIO's making of the se…
International Protection for People Displaced across Borders in the context of Climate Change and Disasters
Complementary Pathways
Amid ongoing displacement crises and shrinking protection space, complementary pathways have emerged as promising avenues for refugees to find safety and solutions through work, study, and sponsorship programmes. Framed as “complementary to” more traditional solutions, such as resettlement, they engage a wider range of actors and aim to benefit both refugees and host States. However, this article argues that linking complementary pathways too clo…
International Protection, Disasters and Climate Change
This paper starts by situating international protection as but one legal response to the situation of people outside their countries due to disasters (section 2). Instead, migration law will often be the primary framework for resolving mobility issues in this context. Nonetheless, for persons who do face a risk of harm, international protection law may potentially apply. The paper sets out guidance, for international protection purposes, on how t…

Expanding durable solutions for refugees
As the number of people forced to flee their homes continues to grow each year, traditional legal frameworks for protecting those who move, such as refugee and human rights law, are increasingly under strain. The limited scope of these frameworks, and diminishing political will to implement them, leave countless refugees and other forced migrants with little chance of finding long-term safety and rebuilding their lives. It is increasingly apparen…
Childhood abuse, pregnancy-related anxiety and the mediating role of resilience and social support
Physical, sexual and psychological abuse were examined as risk factors for pregnancy-related anxiety with resilience and social support as mediators. Pregnant women ( n = 638) completed measures of pregnancy-related anxiety, resilience, perceived social support and childhood abuse. Women with an abuse history had higher pregnancy-related anxiety scores ( m = 64.40) than other women ( m = 55.36). All abuse types independently predicted pregnancy-r…
The Concept of “International Protection” in the Global Compacts on Refugees and Migration
The adoption in 2018 of two Global Compacts, one on Refugees and the other on Migration, has reinvigorated longstanding debates about the distinction between these two groups. On the one hand, differentiating between the two is crucial to ensuring that people forced to leave their homes are not removed to any place where they face a real risk of persecution or other serious harm. On the other hand, drawing a hard line between them does not reflec…
The Health of African American Grandmothers Raising Grandchildren
The study explored the experiences of African-American grandmothers residing in rural communities caring for their grandchildren, while suffering from chronic health issues. The research examined their physical and emotional health, physical functioning, well-being, social support, and resources of these grandmothers from a Family Development approach. Given the trends of providing care for a grandchild, it is widely recognized that caregivers ma…
Who Is a Refugee in Africa? A Principled Framework for Interpreting and Applying Africa’s Expanded Refugee Definition
Africa’s expanded refugee definition – article I(2) of the 1969 Convention – provides the legal basis of protection for a significant number of the world’s refugees. It is a gateway to a host of rights aimed at protecting refugees from future harm and preserving their dignity until a durable solution can be found. The expansive nature of the African definition has seen it praised for being more humanitarian, more reflective of current causes of d…
Prospects for the Global Compacts in Africa
Africa is one of the world's most mobile regions. In 2017, the United Nations (UN) reported that there were nearly 25 million people living outside their countries of origin in Africa. 1 The vast majority of African migration occurs within Africa -approximately 80 per cent of those who move stay within the continent. 2 However, significant numbers also move further afield, to Europe and elsewhere. Despite the importance of migration in Africa, in…
III. Australian Asylum Policy all at Sea
On 25 July 2011, the governments of Australia and Malaysia announced that they had entered into an ‘Arrangement’ for the transfer of asylum seekers. 1 Its stated aim was to deter asylum seekers from travelling by boat to Australia by providing that the next 800 asylum seekers to arrive unlawfully would be transferred to Malaysia in exchange for the resettlement of 4,000 UNHCR-approved refugees living there. 2 The joint media release by the Austra…
