This article examines 21st century wars and the growth in refugee numbers and changes in the nature of the conflicts producing them, drawing from data on refugee numbers and on battle-related deaths from 2014. The article explores the international rights at issue in expulsion and the content of the corresponding effective remedy required of a State. International treaty body jurisprudence from individual cases is critically examined to expose progress and problems remaining for both the rights and the effective remedy. Reconceiving Resettlement Services as International Human Rights Obligations
The author draws on international treaties to argue that the provision of immigrant and refugee settlement services are human rights obligations. Therefore, services such as primary health care, food, education and housing are minimum core obligations that should be available to newcomers without discrimination. The article discusses the fundamental role played by the notion of equality and shows that a general promise of equality is a hallmark of the UN system to which non-citizens’ may lay claim. The UN Committee on the Rights of the Child and Refugees: One NGO's Experience with the Reporting Process
During 1994 and 1995, the InterChurch Committee for Refugees (ICCR) developed a brief to the UN Committee on the Rights of the Child. The brief was to assist the Committee in its examination of Canada's first report required under the Convention on the Rights of the Child. This article describes the brief, the process ICCR entered into, and the resulting "Report Card" from the UN Committee. Some follow-up work is described briefly
