Pop music production and regulation online in select African countries and Brazil
Over the last quarter of a century, the sources of the global recorded music industry's revenues have changed fundamentally, from 100 per cent physical sources (mostly compact discs [CDs]) in 1999 to diversified sources between 2010 and 2015, to mostly intangible sources (mostly streaming) thereafter. However, such global statistics tell us little about developments on the ground in countries with very different socio-economic and cultural circum…

A Critique of the Ontology of Intellectual Property Law
Intellectual property (IP) law operates with the ontological assumption that immaterial goods such as works, inventions, and designs exist, and that these abstract types can be owned like a piece of land. Alexander Peukert provides a comprehensive critique of this paradigm, showing that the abstract IP object is a speech-based construct, which first crystalised in the eighteenth century. He highlights the theoretical flaws of metaphysical object …
Critique of the Ontology of Intellectual Property Law
Intellectual property (IP) law is among the oldest and most comprehensive areas of uniform private law. Nearly all countries are members of the World Intellectual Property Organization and as such agree »to promote the protection of intellectual property throughout the world«. The problem, however, is that this legal protection is subject to the equally universally acknowledged territoriality principle. IP rights are limited to the territory of t…

Plagiarism, i.e. the appropriation of other people's material without giving proper credit, is widely considered as one form of scientific misconduct. The article shows, however, that the introduction of notions of intellectual property into the regulation of scientific and scholarly research tends to obfuscate the proper aims of the latter. As an alternative, the article develops a concept of research integrity that draws inspiration from unfair…
