  • Two Conceptions of Instrumental Thought

    Open Access•Rory O’connell•ARTICLE•The Philosophical Quarterly•2024•References: 8

According to a dominant assumption the truth of instrumental thoughts-thoughts in which one action is identified as a means to another-are not affected by agents' normative conceptions of their ends. Agents could in principle grasp these thoughts, and thereby the correct means to their ends, without consulting any conception they may have as to the pursuit-worthiness of those ends. I argue this assumption (the 'Theoretical Conception') prevents u…

  • The Constitution of Ireland: A Contextual Analysis

    Open Access•Rory O’connell•ARTICLE•The American Journal of…•2022

Oran Doyle’s book appears in the Hart Series on Constitutional Systems of the World and covers the Constitution of Ireland up until 2018. The book continues the admirable ethos of providing introductions to constitutional systems that are concise and accessible but also sophisticated. Chapter 1 reviews the history of Ireland and the influences on constitutional developments including the partition of Ireland into the twenty-six-county Irish Free …

  • “I Do What Happens ”: The Productive Character of Practical Knowledge

    Open Access•Rory O’connell•ARTICLE•Canadian Journal of Philosophy•2020

Elizabeth Anscombe introduced the notion of “practical knowledge” into contemporary philosophy. Philosophers of action have criticized Anscombe’s negative characterization of such knowledge as “non-observational,” but have recently come to pay more attention to her positive characterization of practical knowledge as “the cause of what it understands.” I argue that two recent Anscombean accounts of practical knowledge, “Formalism” and “Normativism…

  • Azadeh Chalabi, National Human Rights Action Planning

    Open Access•Rory O’connell•ARTICLE•Human Rights Law Review•2019

This is an ambitious, wide-ranging and thorough examination of issues related to national human rights actions plans. It is ambitious in the best sense and in multiple ways. Despite the seemingly narrow focus on one specific aspect of human rights protection, the book analyses national human rights action plans in a comprehensive way, covering the theoretical, doctrinal, empirical and practical aspects. Within the covers of the modestly titled bo…

  • Applying an International Human Rights Framework to State Budget Allocations: Rights and Resources

    Open Access•Rory O’connell, Rory O'Connell et al.•BOOK•Applying an International Human…•2014

Human rights based budget analysis projects have emerged at a time when the United Nations has asserted the indivisibility of all human rights and attention is increasingly focused on the role of non-judicial bodies in promoting and protecting human rights. This book seeks to develop the human rights framework for such budget analyses, by exploring the international law obligations of the International Covenant on Economic, Social and Cultural Ri…

  • Human Rights and Public Finance: Budgets and the Promotion of Economic and Social Rights

Aoife Nolan, Colin Harvey et al.•BOOK•Human Rights and Public Finance•2013

This edited collection addresses some of the most important challenges in contemporary human rights law and practice. Its central theme is the linkage between public finance, particularly budget decisions, and the realisation (or not) of economic and social rights. While much academic and political debate on economic and social rights implementation has focused on the role of the courts, this work places the spotlight squarely on those organs of …

  • Ambition, achievement and potential: The UK and the Universal Declaration of Human Rights at sixty

Tom Obokata, Rory O’connell•ARTICLE•The International Journal of…•2010•Cited by: 1

In this article the authors examine the role of the Universal Declaration of Human Rights (UDHR) in UK law, politics and society, with a particular focus on its role in UK law. Despite the UDHR being conceived as a Declaration and not binding law, it has the potential to influence the development of the law. There is considerable moral force associated with it as the foundational document of modern human rights law. The authors argue that the Uni…

  • The Right to Participation of Minorities and Irish Travellers

    Open Access•Rory O’connell•ARTICLE•Studies in Ethnicity and…•2008•Cited by: 1•References: 4

The idea of participation is becoming increasingly important in international human rights law and recent political and constitutional theory. There is an emerging international law on the right of minorities to participate in public life. There are many problems, however, with putting this right into practice. It is not enough to offer formal opportunities for representation or even to facilitate more participatory processes. This article explor…

  • Legal Responses to Racism: Innovation and Retrenchment in Ireland

    Open Access•Rory O’connell•ARTICLE•International Journal of…•2005

Following decades in which the absence of immigration allowed Governments to claim there was no problem of racism in Ireland, the 1990s saw Ireland adopt new equality measures to combat racism. Whilst these innovations are important and even innovative, paradoxically they are accompanied by policy initiatives which indicate the equality agenda is still very much a controversial one and possibly even in retreat. More radical reforms are needed tha…

  • Theories of Religious Education in Ireland

Rory O’connell, Rory O'Connell•ARTICLE•Journal of Law and Religion•1999

In this article I argue that an accommodationist approach to Church-State relations provides the most appropriate interpretation of the Irish Constitution. This accommodationist interpretation is however incompatible with Ireland's system of almost exclusively denominational education, in which denominational schools of all the Churches are funded
