Open Access•Martin Scheinin, Mattias Åhrén•ARTICLE•Nordic Journal of Human Rights•2026

Over four decades, Indigenous Sámi individuals and communities have submitted to United Nations human rights treaty bodies, including the Human Rights Committee, several complaints in respect of the three Nordic countries Finland, Norway, and Sweden. Many of these Sámi rights cases have made important contributions to the understanding and application of Indigenous peoples’ rights globally, in addition to pushing for awareness and reform at home.…

Open Access•Tetyana Krupiy, Martin Scheinin•ARTICLE•Human Rights Law Review•2023

While scholarship on ‘digital discrimination’ is growing, scholars have paid less attention to the impact of the use of artificial intelligence decision-making processes on persons with disabilities. This article posits that while the use of artificial intelligence technology c…

  • The Italian Constitutional Court’s Judgment 238 of 2014 Is Not Another Kadi Case

    Martin Scheinin•ARTICLE•Journal of International Criminal…•2016

This article provides a critical view of Judgment No. 238 of 2014 handed down by the Italian Constitutional Court. By and large the comments presented below pertain to the single issue of the relationship between different legal orders — between the legal orders of two states, or between the legal order of one state and the legal order of international law. The following comments are based on a postulate that law is pluralist in its structure. La…

Human rights are considered one of the big ideas of the early twenty-first century. What is the relationship between culture and human rights? Can the idea of cultural rights, which are predicated on the distinctiveness and exclusivity of a community’s beliefs and traditions, be compatible with the concept of human rights, which are universal and ‘inherent’ to all human beings? If we accept such compatibility, what is the actual content of cultural rights? Who are their beneficiaries: individuals, or peoples or groups as collect…
