The Hollow Hope
The Importance of Being Political
This article examines the evolving jurisprudence of the US Supreme Court’s decisions on the constitutionality of affirmative action with specific focus on education. Traversing the Court’s affirmative action decisions from the 1970s to 2013, the author argues that the best, and possibly only, way to understand the evolution of this politically contentious doctrine is to focus on politics. This requires paying attention to political commitments of…
The Triumph of Politics
In this article, Gerald N Rosenberg revisits his 2014 argument that the US Supreme Court is a political institution. Its decisions in affirmative action cases in education are best understood through the political preferences of the justices. Eight years later, the author finds that the Court's opinions have only strengthened this argument. The article analyses affirmative action cases in education between 2014 and mid-2022 and illustrates the po…

Rodrigo's Fourth Chronicle
I was in my office late one afternoon, puzzling over how to incorporate four recent books addressing the role of courts in protecting minority rights into the next edition of my casebook. The first of these books, Derrick Bell's Faces at the Bottom of the Well,' argues that racism is likely to prove a permanent feature of America's cultural landscape.2 The faces are those of African-Americans whose existence at the bottom of society enables even …

The Hollow Hope
In follow-up studies, dozens of reviews, and even a book of essays evaluating his conclusions, Gerald N. Rosenberg's critics - not to mention his supporters - have spent nearly two decades debating the arguments he first put forward in Hollow Hope. With this substantially expanded second edition of his landmark work, Rosenberg himself steps back into the fray, responding to criticism and adding chapters on the same-sex marriage battle that ask an…

Judicial Independence and the Reality of Political Power
Defining judicial independence as the ability of courts to make decisions in the short term without regard for the preferences of officeholders, this article empirically examines the conditions under which judicial independence is and is not likely to be found. Nine periods of intense congressional hostility to the Supreme Court are identified and Court reactions are chartered along a continuum from pure independence to total subservience. Examin…
