Upscaling marine and coastal restoration through legal and governance solutions
There is a global imperative to upscale restoration in line with the Kunming-Montreal Global Biodiversity Framework. Upscaling of marine and coastal restoration is hindered by legal and governance barriers. Identifying both the types of barriers and potential solutions from global ‘bright spots’ is a first step toward implementing legal and governance frameworks to facilitate upscaling of marine and coastal restoration. Here we identify five type…
Identifying priorities for reform to integrate coastal wetland ecosystem services into law and policy
The ecosystem services concept has been slow to integrate into written law and policy in Australia. We sought to examine whether the concept has permeated deeper into practice, focusing on the coastal wetland protection, management and restoration context. We conducted a Delphi study involving 16 key informants. Over two rounds of interviews we found confirmation that the ecosystem services concept is not a central part of practice, and a strong …
Operationalizing marketable blue carbon
Human rights and climate change litigation
This article examines how the concept of temporal imminence has evolved to become a precondition to a violation of a positive human rights obligation in a number of jurisdictions. We trace the case law back to its roots, especially in the European Court of Human Rights and the Inter-American Court of Human Rights, and find no clear rationale for its inclusion as a criterion of positive obligations in some cases, and serious divergence between cas…
Policy solutions to facilitate restoration in coastal marine environments
Do conservation covenants consider the delivery of ecosystem services
Queensland’s Human Rights Act
In 2019, the Queensland Parliament enacted a Human Rights Act, enshrining, inter alia, the human right to life. The Human Rights Act 2019 (Qld) presents a timely opportunity to open the next chapter in Australia’s climate change litigation history – a human rights-based climate change case. This article will consider the possible characterisation of such a case, drawing on international experience. Ultimately, it will conclude that a rights-based…
Legal barriers and enablers for reintroducing tides
Maps, laws and planning policy
Rapid sea level rise over the 21st century threatens coastal settlements and populations worldwide. Significant land-use policy reform will be needed to mitigate exposure to hazards in the coastal zone. Sea-level rise maps that indicate areas that are potentially prone to future inundation are a valuable tool for policymakers and decision makers. However, errors, assumptions, and uncertainties inherent in spatial data are not often explicitly rec…
