The Dynamics of Enduring Property Relationships in Land
This article proposes a new way of looking at property relationships that will enrich our understanding of how they operate. It focuses on property rights in land which are consensual in origin, although this approach could usefully be applied both to non‐consensual property relationships and to other property types. Recognising both the temporal and spatial dimensions of land, the dynamics approach reflects the fact that most property relationsh…

The Right to Buy
This paper examines the development of the Right to Buy, introduced by the Housing Act 1980, from the standpoint of governmentality, risk and responsibilization. Our focus is on the risks not only to the purchasers but also to local authorities and to those tenants who have not purchased their homes. We trace how these risks have been assessed, allocated and rebranded, by central government, by local authorities as landlords with wider responsibi…

A Picture of the Floating World
A quarter century of financial deregulation, robber‐baron corporatism and growing income polarisation has enabled the spatial partitioning of urban space into new and complex arrangements of micro‐neighbourhood governance and privatism. These archipelagos of fortress homes and neighbourhoods increasingly lie outside the spaces of conventional state and city government. Yet while residential spaces of urban affluence have been unable to fully remo…
Incivilities
Oxford : Hart ( 2006 ) 304pp. £37.00hb ISBN 978-1-8411-3499-4 This edited collection is the product of two inter-disciplinary colloquia on the subject of incivilities, held in Cambridge in 2002 and 2003. Amongst the eleven contributors are philosophers, criminologists, a sociologist, and penal theorists. The editors say in their brief preface that their aim was to explore principles that might define and limit the scope of what they term ‘quality…
Researching the Judiciary
From introduction: This paper concerns the the processes involved in developing a study method appropriate to exploring the way in which judicial discretion is exercised in the County Court. The specific context is possession cases brought against the tenant of social landlords on the grounds of rent arrears. The work is based on an empirical project commissioned by the Department of Constitutional Affairs (DCA) in the spring of 2004
Panic Rooms
This paper documents how and attempts to explain why homeowners have adopted an increasingly strategic approach to the defence of the home and the progressively vengeful pursuit of those who invade the home. This approach has been articulated via the political process as well as through a media ‘conversation’ that form a milieu within which defensive homeownership has emerged. It is suggested that a threshold has been crossed marking a transforma…
Gated Communities
Gated communities are becoming increasingly common across England, yet very little is known about the impact these developments have upon the residents of the wider community or those within the confines of the gates. This paper draws on empirical research carried out in a gated community in the north of England to explore social ties amongst the residents, in the presence of a legal framework (lease and residents' management company) which provi…

Reforming Leasehold
This article uses discourse analysis to explore and explain the limits of ongoing efforts to resolve the problems experienced by long leaseholders living in private flats in England and Wales. Attention is focused on the position of leasehold within the three discourses of property law, housing, and housing law, as revealed through the language used in legislation, consultation papers, Law Commission reports, political statements, media represent…
