  • The Cambridge Handbook of Technological Disruption in Labour and Employment Law

Open Access•Valerio De Stefano, Mathias Wouters et al.•BOOK•The Cambridge Handbook of…•2023

Whether through gig work, remote work, or platforms such as Uber, new technologies are reshaping the very fabric of employment relations. This handbook offers a comprehensive, international overview of how institutions, countries, and legal systems are responding to the technological disruption of the work world. Chapters outline the reform agendas driven by the International Labour Organization and the European Union and detail the public policy…

  • When (EU) migration came to Great Yarmouth

    Open Access•Catherine Barnard, Fiona Costello•ARTICLE•Contemporary Social Science•2023•Cited by: 1•References: 20

This article examines the impact of EU migration on Great Yarmouth, a coastal town in Norfolk, England. Great Yarmouth had the fifth highest ‘leave’ vote nationally in the UK Brexit referendum, at over 70%. In this article, we want to show that Great Yarmouth has always been a town of migration but the sudden arrival of large numbers of EU nationals, exercising their free movement rights, in a relatively short space of time has created divisions …

  • Movement of Goods under the TCA

    Open Access•Catherine Barnard, Emilija Leinarte•ARTICLE•Global Policy•2022

For many people, trade is about goods and so the most momentous aspect of the Trade and Cooperation Agreement (TCA) is the provisions on goods. This article looks at the provisions on the trade in goods under the TCA and compares them with those on the Customs Union and the Single Market for goods under EU law (which still apply to Northern Ireland under the Ireland/Northern Ireland Protocol). It argues that the approach to the movement of goods …

  • (Legal) assistance in employment matters to low-paid EU migrant workers in the East of England

Open Access•Catherine Barnard, Fiona Costello et al.•ARTICLE•Legal Studies•2022

This paper explores the everyday lives of low-paid, low-skilled EU migrant workers living in and around Great Yarmouth in the East of England both pre- and post-Brexit. It considers the legal problems they face, especially around employment law, and how those problems may be resolved. It draws on the results of quantitative and qualitative research to examine the reach of law into the everyday lives of vulnerable EU migrants. We term our research…

  • EU ‘Social’ Policy From Employment Law to Labour Market Reform

    Catherine Barnard•CHAPTER•Evolution of EU Law•2021

This chapter presents four stories about the evolution of EU social policy. The first is the historical evolution of social policy. The second concerns the contribution of the Court of Justice to the development of a distinctive EU social policy. The third story is about a reorientation of approach to regulating the labour market in the EU. It is a story that cannot be told through hard law measures on employment law, but through documents on emp…

  • The changing status of European Union nationals in the United Kingdom following Brexit

    Open Access•Catherine Barnard, Sarah Fraser Butlin et al.•ARTICLE•Social & Legal Studies•2021•Cited by: 14•References: 17

Following Brexit, European Union citizens now find their rights to live and work in the UK have changed and they had to make an application under the European Union Settlement Scheme, established under the terms of the Withdrawal Agreement, by 30 June 2021 to enable them to continue to live in the UK lawfully. This article examines the experience and perceptions of those navigating the European Union Settlement Scheme and how they feel about life…

  • The Rule of Law and Access to the Courts for EU Migrants

Open Access•Catherine Barnard, Sarah Fraser Butlin•ARTICLE•JCMS Journal of Common Market…•2020•Cited by: 1

The ability of workers generally to enforce their labour rights in the UK has been a matter of ongoing discussion over a number of years. However, the dominance of the topic of immigration in the Brexit debates, along with questions surrounding the need for, and position of, EU migrant workers in the British labour market, has brought into sharp focus the issues facing the most vulnerable workers in their ability to enforce their employment right…

  • So Long, Farewell, Auf Wiedersehen, Adieu

    Open Access•Catherine Barnard•ARTICLE•Modern Law Review•2019

The UK's relationship with the Charter of Fundamental Rights of the European Union can at best be described as strained, at worst, actively hostile. The Charter was, for the UK, an unwanted child, unloved at birth, grudgingly tolerated during life, and willingly surrendered at the death of the UK's membership of the EU. This article charts the UK's approach to the Charter from its inception to its demise in the EU (Withdrawal) Act 2018. It consid…

  • A European Social Union after the Crisis

Open Access•Frank Vandenbroucke, Catherine Barnard et al.•EDITOR•BOOK•European Social Union after the…•2017

Today, many people agree that the EU lacks solidarity and needs a social dimension. This debate is not new, but until now the notion of a 'social Europe' remained vague and elusive. To make progress, we need a coherent conception of the reasons behind, and the agenda for, not a 'social Europe', but a new idea: a European Social Union. We must motivate, define, and demarcate an appropriate notion of European solidarity. We must also understand the…

  • Gender Equality in the EU

Catherine Barnard•CHAPTER•The EU and human rights•1999

The realization of sex equality has been the central and most highly developed pillar of the European Community’s fragile social policy. For the Commission, equal opportunities is the ‘legal framework reflecting social policy at European level [which] has been a catalyst for change in the Member States’. The importance of equal opportunities to the Community is underlined in the Commission’s vision of a ‘European social model’. This is based arou…

  • Softening the approach to quotas

Catherine Barnard, Tamara Hervey•ARTICLE•The Journal of Social Welfare Law•1998•References: 1

Background Formal equality between men and women is a long-established principle of Community sex discrimination law. Article 119 on equal pay was included in the original EEC Treaty and, during the 1970s, more specific directives were adopted on equal pay and equal treatment (Directive 75/117/EEC OJ 1975 L 45/19, Directive 76/207/EEC OJ 1976 L 39/40 and Directive 79/7/EEC OJ 1979 L 6/24). However, recognition of the limits of the law in achievin…
