How differently actors cope with demanding constitutional amendment rules: Two types of constitutional politics in federal democracies
The article seeks to explore why a high formal hurdle for constitutional amendments (constitutional rigidity) as it is present in Germany does not automatically lead to a lower number of amendments when compared with low rigidity countries and why Germany’s amendment rate is so much higher than that of some other federations. It theorizes that the frequency of interactions between stable, interdependent actors influences their willingness to comp…
Explaining the Frequency of Constitutional Change in the GermanLänder: Institutional and Party Factors
In this article, we try to explain why some German Land constitutions are changed more frequently than others. Notably, we consider three arguments: first, we point out that subnational constitutional politics are an important, permanent, and salient issue in the German Länder. Second, we examine the extent to which parties and features of subnational constitutions impact the number of constitutional amendments in the German Länder. The analysis …

Rights of Minors and Constitutional Politics in the German Länder. Legal Framework, Party Strategies, and Constitutional Amendments
The article analyses constitutional politics in the German Länder in the field of minors’ rights. Since this issue seems a purely legal matter dealt with at the federal, European and international level, we should expect similar, almost identically shaped policies at the Länder level. However, the analysis brings considerable variations of constitutional activities in this field to the fore: time, frequency, and contents of respective initiatives…
The Ambiguity of Veto Power in Coalitions: German Liberals' Role as a Watchdog in Justice and Home Affairs and their Failure to Sell Stalemate as Success in the Federal Elections of 2013
The article demonstrates that the rigid use of veto capacity in coalitions causes risks for re-election. Justice was a high-salience domain of the German Liberal Democratic Party (FDP), which occupied this portfolio in its coalition with the Conservative majority in the federal legislative period from 2009 to 2013. By analysing several legislative projects the article shows that their contents or non-adoption were an effect of liberals' vetoes. T…

Crossing and Controlling Borders: Immigration Policies and Their Impact on Migrants' Journeys
This volume highlights the impact of border controls on migrants’ journeys in two major areas of immigration: the European Union and the United States of America. In order to show the linkages between border control policies and migratory practices, the book combines empirical insights from ethnography with approaches from political science. Describing migrants’ realities reveals that the impact of border control policies goes beyond the actual b…

Constitutional Negotiations in Federal Reforms: Interests, Interaction Orientation and the Prospect of Agreement
Constitutional amendments in federal political systems have to be negotiated between national and subnational actors. While theories of negotiation usually explain the outcome by looking at these actors, their preferences and bargaining powers, the theoretical model developed in this article also includes their interaction orientation. The article determines a typical sequence of bargaining and arguing and identifies favourable conditions for co-…
Verfassungspolitische Konjunkturzyklen?
Verfassungsänderungen in etablierten Demokratien
In etablierten Demokratien finden permanent Verfassungsänderungen statt.

How to Measure Constitutional Rigidity: Four Concepts and Two Alternatives
This article deals with the (possible) explanation of constitutional development by the rigidity of the constitution itself, for example the difficulty of the amendment process. Four concepts of measuring rigidity are tested theoretically and their respective outcomes concerning the frequency of constitutional reforms are explained. The strikingly different results show how important it is to discuss and to test operationalizations of abstract te…
