Mapping the European Landscape of Citizens’ Initiatives
Rising public dissatisfaction with representative democracy has sparked interest in bottom-up forms of direct democracy, such as citizens’ initiatives. Yet, systematic data on actual practice remain scarce. This article maps citizens’ initiatives across 46 Council of Europe states, covering both agenda initiatives and citizen-initiated referendums. Drawing on an original database of nearly 7’000 initiatives launched between 1990 and 2020, we reve…
International Human Rights Law
Written by leading experts in the field, International Human Rights Law explores the essentials of international human rights law, from foundational issues to substantive rights and systems of protection. It also addresses contemporary challenges, such as climate change and pandemics, ensuring students are aware of the current and future importance of these issues. A variety of perspectives bring this multifaceted and sometimes contentious subjec…
Interpretation of the ICESCR
The Committee on Economic, Social and Cultural Rights has developed a number of methods for interpreting the ICESCR that are often described as ‘special’ and as falling outside the framework of VCLT articles 31–33. However, this chapter argues that the VCLT can accommodate these methods. The real problem with the Committee’s interpretations is not their (il)legality but their (lack of) legitimacy. The Committee seems to equate legitimacy with suf…

The human rights covenants at 50: Their past, present and future
Half a century ago, on 16 December 1966, the UN General Assembly adopted the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). While the adoption of the two UN human rights covenants was celebrated all over the world, their 50th anniversary has received very little attention from the international community. The present book marks this anniversary by takin…
Referendums: Tyranny of the Majority
This response piece argues that one should be wary of generalised statements that referendums – or particular types of referendums – are good or bad. Whether a popular vote process has beneficial or damaging effects depends on a myriad of factors, in particular its formal design and the constitutional structure of the state concerned. Similarly, sweeping claims that referendums result in the oppression of minorities should be approached with a go…
Exclusion from Public Space: A Comparative Constitutional Analysis
Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased c…
Human Security and Non-Citizens: Law, Policy and International Affairs
The past decades have seen enormous changes in our perceptions of 'security', the causes of insecurity and the measures adopted to address them. Threats of terrorism and the impacts of globalisation and mass migration have shaped our identities, politics and world views. This volume of essays analyses these shifts in thinking and, in particular, critically engages with the concept of 'human security' from legal, international relations and human …
