A Partnership of Convenience? Transnational Civil Society, International Organisations and Practices of Global Order
Reform, Transformation, Emancipation
This article outlines a theoretical framework for interpreting the meaning and function of political protest in modern democracies and develops normative criteria for assessing its democratic quality. To allow for a better understanding of how social structures, legal institutions, and political engagement interact in protest, I combine analytical perspectives from social theory and democratic theory. A useful first distinction, I argue, is betwe…
Protest and the Democratic Order
The introduction of this special issue elaborates a research perspective on the meaning and function of political protest in the context of democratic orders. Starting from the consideration that protest and democratic orders form a close interrelationship, we ask how and to what extent democracy is imagined, negotiated, and problematized within protest, and how democratic orders and politics shape the formation of protest. To this end, we argue …
The Problem of Sovereignty in Globalized Times
This article argues that the delineation of the current debate on sovereignty in times of globalization and the manner of questioning are problematic. Although various understandings of sovereignty differ in terms of content, they nevertheless reproduce the same conceptual structure: of a rigid binary separation into internal/external, national/global, a container theory of space, the need to search for the supreme, a (political, ethical, legal) …
Formwandel der Demokratie
Enacting a parallel world
Global capitalism is a transnational “operational space” (Sassen) which is (re)produced by the practices of states, policy- and issue-specific government networks, and private organizations such as transnational corporations, global law firms, and standard-setting agencies. This “operational space,” which I call the transnational constellation, works through and beyond distinct spatial settings (i.e. local, glocal, national, global), endowing the…
On a radical democratic theory of political protest
The increasing number of protest activities urges political and social philosophers to analyze the meaning and function of protest in modern democracy. Its focus on conflictive social relations makes radical democratic theory the most promising approach currently at hand for such an endeavor. It allows us to comprehend today's form of protest as a critique of the current shape of modern democratic order (and not as interest politics or as a strug…
Towards a critical theory of the political
The phrase ‘critique of power’ refers to that analytical program within social philosophy that concerns the discord between the individual and the social orders. From the perspective of many critical theorists, Hannah Arendt’s conception of power, however, is considered unsuitable for such a critical enterprise. In contrast to this assumption, the article argues for reading Hannah Arendt’s concept of power in the light of a critical theory of the…

From Nomos to Lex
‘What is politics?’ is an omnipresent question in Hannah Arendt's work and one which is broadly explored in countless publications. ‘What is law?’, in contrast, is a question which has not been of much interest to Arendt scholarship to date. There is a good reason for this: Arendt's engagement with law seems not to be systematic but, rather, episodic and sporadic. However, on the basis of three different discourses – historical, political-theoret…
