Einheitsrecht im internationalen Warentransport
The roots of uniform law in the field of transport law can be traced back to antiquity. Today, a number of international conventions form a uniform law for almost all types of common carriers. Those conventions for trains, trucks and inland navigation vessels, however, must be characterized as regional, even if they encompass three continents. Yet, they are not applicable worldwide. Explaining group membership in the European Parliament: The British Conservatives and the Movement for European Reform
This article examines the decisions behind group membership in the European Parliament (EP) using a rational-choice institutionalist framework. Following the goals ascribed to them by Strøm (1990) in other settings, national parties should join the largest group that matches their socioeconomic preferences. Yet, whilst explanations taking national parties as the basic unit of analysis might sometimes suffice, we argue that it is often necessary t…
The German Council Presidency: Managing Conflicting Expectations
The European Parliament, the national parliaments and the EU Conventions
This paper explores the Convention method along the theoretical concept of deliberative democracy. It argues that the Convention method, in comparison with IGC’s, can be seen as an alternative way for steering system change and fundamental reform of the European Union. Hence it features participative and inclusive forms of open deliberation, it respects and integrates the relative importance of minority positions, it offers open fora for parliame…
The Legislative Powers and Impact of the European Parliament
This article investigates the impact of the legislative powers of the European Parliament (EP), particularly the co‐decision procedure. After explaining the development of the legislative procedures, the article analyses the extent to which the different procedures have been used since their creation. It then considers how growing legislative power has affected the EP's internal development, how far the EP has been able to influence EU legislatio…
The European policy-making machinery in the Berlin republic: Hindrance or Handmaiden
This article examines European policy-making in the Berlin Republic. The basic puzzle explored is whether the policy machinery is able to facilitate the projection of a ‘new European policy’, characterised by greater emphasis upon national interests. In order to suggest answers, the article reviews the origins of the policy machinery and the changes made in the pre-unification period. It then explores the current situation in the Berlin Republic.…
