Foreword by the Co-Editors of the ICLQ Forum on the Law of the Sea
This foreword introduces the inaugural International and Comparative Law Quarterly (ICLQ) Forum, a new initiative designed to provide in-depth analysis of a particular field of law within the ICLQ’s sphere of interest. The first Forum focuses on the law of the sea, a subject with which the journal has been closely associated since its inception. The choice of theme reflects both the ICLQ’s historic contributions to maritime scholarship and the re…
Future advances in UK marine fisheries policy
Having left the European Union, the UK Fisheries Act (hereafter referred to as the Act) provides a framework that may advance sustainable marine resource management. This requires the bias towards social-economic concerns to be recognised, and greater emphasis to be placed on securing the natural capital to support fisheries. A Joint Fisheries Statement (JFS) to be published in 2022 by the UK’s devolved fisheries authorities will set out how the …
The future of marine fisheries management and conservation in the United Kingdom
Marine wild-capture fisheries depend on the capacity of the ocean to provide a flow of harvestable resources to sustain the industry. Paradoxically, conventional fishing often undermines these resources by degrading the environment and overexploiting fish stocks. Many UK fisheries have declined for over a century due to a biased focus on their social-economic value and lack of recognition that they are social-ecological systems and need to be man…
Finding Antarctica’s Pole of Inaccessibility
Antarctica’s Pole of Inaccessibility (Southern Pole of Inaccessibility (SPI)) is the point on the Antarctic continent farthest from its edge. Existing literature exhibits disagreement over its location. Using two revisions of the Scientific Committee on Antarctic Research’s Antarctic Digital Database, we calculate modern-day positions for the SPI around 10 years apart, based on the position of the “outer” Antarctic coastline, i.e. its boundary wi…
Gerrymandering and Compactness
Political districts may be drawn to favor one group or political party over another, or gerrymandered. A number of measurements have been suggested as ways to detect and prevent such behavior. These measures give concrete axes along which districts and districting plans can be compared. However, measurement values are affected by both noise and the compounding effects of seemingly innocuous implementation decisions. Such issues will arise for any…

Lessons from an online teacher preparation Program
In the United States, educator preparation is regulated at the state level. Accordingly, each state education system, and even individual districts, responded uniquely to the COVID-19 pandemic. Western Governors University (WGU) compiled a list of each state regulators’ response to COVID, many of which included relaxation of student teaching requirements. While most of WGU’s teacher preparation programme is delivered online, students complete obs…
The Capacity of Property Rights to Accommodate Social-Ecological Resilience
Here, I consider how social-ecological resilience can be facilitated by the use of property rights. Taking a legal perspective on the use of different forms of property, I consider how property rules can manifest the attributes of flexibility, responsiveness, optionality, and scalability associated with resilient systems. I note how different regulatory regimes such as domestic law and international law have differing capacities to accommodate pr…
Strong Tobacco Control Program Requirements and Secure Funding Are Not Enough
Florida’s Tobacco Pilot Program (TPP; 1998–2003), with its edgy Truth media campaign, achieved unprecedented youth smoking reductions and became a model for tobacco control programming. In 2006, 3 years after the TPP was defunded, public health groups restored funding for tobacco control programming by convincing Florida voters to amend their constitution. Despite the new program’s strong legal structure, Governor Charlie Crist’s Department of He…
Regulating the disposal of cigarette butts as toxic hazardous waste
The trillions of cigarette butts generated each year throughout the world pose a significant challenge for disposal regulations, primarily because there are millions of points of disposal, along with the necessity to segregate, collect and dispose of the butts in a safe manner, and cigarette butts are toxic, hazardous waste. There are some hazardous waste laws, such as those covering used tyres and automobile batteries, in which the retailer is r…
Cigarettes Butts and the Case for an Environmental Policy on Hazardous Cigarette Waste
Discarded cigarette butts are a form of non-biodegradable litter. Carried as runoff from streets to drains, to rivers, and ultimately to the ocean and its beaches, cigarette filters are the single most collected item in international beach cleanups each year. They are an environmental blight on streets, sidewalks, and other open areas. Rather than being a protective health device, cigarette filters are primarily a marketing tool to help sell 'saf…
Enacting tobacco taxes by direct popular vote in the United States
Tobacco tax ballot measures commonly allocated substantial funds to medical services; tobacco companies are becoming more successful in making this use of funds an issue. Proponents' campaigns should be timed to account for the trend to voting well before election day. Ballot measures to increase tobacco taxes with a substantial fraction of the money devoted to tobacco control activities will probably fare better than ones that give priority to f…

Refugee Law At Sea
Coping with refugees arriving by sea is a problem that has existed for a number of years. 1 Throughout this period the crux of the matter has remained the same, reconciling the humanitarian plight of refugees and asylum-seekers with the destination States' concerns about illegal immigration, mass migrations of people, and the costs of asylum. The boarding of the Tampa by Australian SAS troops in August 2001, in order to prevent the disembarkation…
