Italy’s Lega Nord: Changing Poses in a Shifting National and European landscape
This article examines changing approaches to ethnicity and nationalism of the Lega Nord (LN), a populist far-right political party in Italy, against a backdrop of growing anti-EU and anti-immigrant sentiment. The article reflects on the contexts in which populist and far right politics are taking hold in Italy and in the European Union (EU), with the LN used to illustrate this dynamic. The EU is shaping national politics in new and unexpected way…
Freedom of Expression: European and Australian Perspectives
This article explores the legal frameworks supporting the right to freedom of expression in Europe and Australia. Whereas in Europe there are overlapping protections of this right embedded within highly visible, legally binding instruments, the Australian protection rests on a judicial constitutional implication. Despite fundamental differences in salience, visibility and scope, it appears that neither jurisdiction is averse to limiting the right…
Europe’s wicked legitimacy crisis: The case of refugees
The European Union’s response to the current and persistent – if not wicked – refugee crisis has exposed a new legitimacy challenge. Characterised by interstate bickering and undignified competition for the most draconian measures, the crisis brings to the fore many inherent tensions of the EU which cannot be easily reconciled. The crisis has revealed the many shortcomings of EU governance. Deficits of leadership and solidarity and the rise of xe…
Refugee roulette: Fences, deflected responsibilities and the politics of excision
This article seeks to contextualise Australia’s asylum and refugee policies within international normative frameworks, focusing on jurisdictions in the European Union and the United States by way of comparison. The article finds that the convergence of asylum policies with securitisation and border control produces outcomes inimical to human rights and that the decreasing commitment to asylum seekers is not unique to Australia. The article conclu…

The process of internationalisation is exerting pressure on governments around the world to recognise the rights of their indigenous peoples. This article investigates the current legal framework for minority language protection in Japan, where a history of assimilation has threatened the ancestral language and culture of the Ainu minority. The situation in Japan is contextualised within a broader discussion of minority language protection at glo…

No ode to joy? Reflections on the European Union's legitimacy
Hostile Receptions: Dilemmas of Democracy, Legitimacy and Supranational Law
The increasing resonance of international humanitarian law in the domestic sphere, primarily through the implementation of treaty obligations in domestic legislation, gives international law a relevance to local communities never before seen. Whilst the effects of this phenomenon defy generalisation in Australia today, it is possible to discern a range of responses from indignation at the overarching reach of international law to the domestic spa…
European Integration: Between Micro‐Regionalism and Globalism
With the Convention on the Future of the European Union (EU) now in progress, it is opportune to examine the processes and forces currently shaping the EU's constitutional development and impacting on governmental arrangements. For some time, debate on the constitutionalization of the EU has focused on whether the EU needs a constitution and, if so, what kind of constitution. It is argued that analysis of these core issues cannot be conducted in …
