Troubling Universalism
In “Race, Internationalism, and Comparative Political Theory,” Navid Hassanzadeh critiques those attempts to address the insufficiencies of universalism that simply add non-Western traditions to the canon.1 He shows how the work of W.E.B. Du Bois offers a more productive approach, in which universal norms like democracy are rethought and transformed through an investigation of the black political experience in the United States and the internatio…

Eminent Domain and the Rhetorical Construction of Sovereign Necessity
This article examines the logic of necessity in eminent domain cases in the United States. While much has been written about “public use” justifications as adjudicated by courts, less attention has been paid to necessity. In part this is because public use is an explicit part of Fifth Amendment limitations on “takings” while necessity is part of the buried logic of sovereignty that grounds its exercise. Readings of pivotal cases from McCulloch to…
Judging Necessity: Democracy and Extra-legalism
This article probes the relationship among constitutionalism, extra-legal prerogative power, and citizen judgment. While much has been written about the nature of Lockean prerogative, and while his theory serves as a direct inspiration for contemporary “normative extra-legalists,” key participants in the debate over emergency powers, less attention has been paid to how the people judge prerogative. Attention to this issue is useful because an exa…
Reflexive Democracy: Political Equality and the Welfare State. By Kevin Olson
Terminal Exceptions: Law and Sovereignty at the Airport Threshold
The rise of crisis governance in the United States after September 11, 2001 has raised disturbing questions about the relationship between law and exceptions to the law. The debate over the exception — should it be inside or outside law? — reflects what Giorgio Agamben describes as a threshold where inside and outside meet and blur. I show how this undecidable relation between law and the exception is present in popular culture as well. I argue t…

Redistribution, Recognition, and the State: The Irreducibly Political Dimension of Injustice
Political Judgment with a Difference: "Agonistic Democracy and the Limits of "Enlarged Mentality
This essay considers what it means to exercise good political judgment in the context of the politicization of identity. When Hannah Arendt's discussion of the "enlarged mentality" of the judging subject is amended by HansGeorg Gadamer's phenomenology of play and Pierre Bourdieu's skeptical critique of the faculty of judgment, a more complex picture of the formation of enlarged thought emerges. Genuinely enlarged thought may require something mor…
