  • Safety Zones for Space Resource Activities

    Open Access•Jinyuan Su•ARTICLE•Chinese Journal of International…•2025

The legality of safety zones established for space resource activities is contingent on, first and foremost, the legality of those activities themselves. If and to the extent that space resource activities become lawful, which is a trend in the light of recent State practice, the establishment of safety zones for them is justified by the legitimate right of States to be free from unreasonable interference in the conduct of those activities, combi…

  • Outer Space

    Open Access•Jinyuan Su•ARTICLE•Chinese Journal of International…•2023•Cited by: 1

At the early stage of humankind’s Space Age, the former Union of Soviet Socialist Republics and the United States of America showed an inclination to non-militarize outer space, but distrust also prompted them to carry out a series of high-altitude nuclear tests. In the end, while the non-militarization aspiration materialized on celestial bodies, in the outer void space between them only Weapons of Mass Destruction were prohibited. The last few …

  • Legal status of abiotic resources in outer space

    Open Access•Jinyuan Su•ARTICLE•Leiden Journal of International Law•2022•Cited by: 1

Humankind’s exploration and use of outer space are first and foremost limited by the obligation of non-appropriation. This prohibition, with an aim to prevent conflicts arising from competing territorial claims, does not extend to the exploitation of abiotic resources in space. Recent state practice has shown a clear trend of regarding such exploitation as a freedom of exploration and use of outer space. The future international legal regime shou…

  • Is the Establishment of Air Defence Identification Zones Outside National Airspace in Accordance with International Law

    Open Access•Jinyuan Su•ARTICLE•European Journal of International…•2021

Whereas the right of a state to establish an air defence identification zone (ADIZ) in national airspace falls squarely within its sovereignty, the question whether coastal states may claim such zones outside national airspace remains a matter of controversy. The latter category, referred to as ‘offshore ADIZs’, usually do not amount to sovereignty claims over the open airspace outside national airspace or involve threat or use of force. The righ…

  • The Practice of States on Air Defense Identification Zones

    Open Access•Jinyuan Su•ARTICLE•Chinese Journal of International…•2019

This note provides a survey of the practice of States on ADIZs. It is found that while some ADIZs are entirely within territorial airspace, most extend beyond the outer limit into the airspace above the EEZs and even the high seas; and in the part beyond territorial airspace, transiting aircraft are prevalently subject to identification. Transiting military aircraft, which most of the time refuse to identify themselves voluntarily by submitting a…

  • Legality of Unilateral Exploitation of Space Resources Under International Law

    Open Access•Jinyuan Su•ARTICLE•International and Comparative Law…•2017•Cited by: 6•References: 11

In recent years, there has been a surge of private investment in space resources and the enactment of domestic legislation aimed at protecting property rights over the resources to be extracted. This article argues that the unilateral exploitation of space resources is not prohibited by the principle of non-appropriation and is consistent with the freedom of use for common benefit and interests, with the caveat that it does not exclude others fro…
