  • The Sword in the Zone

Eric A Morgan, Ed Morgan•ARTICLE•University of Toronto Law Journal•2012•Cited by: 1

The theme of this article is that the contradictory impulses found in modern land-use planning law are impossible to overcome. The analysis takes place at two levels; that is, on the level of law and on the level of land-use planning. In the first place, the case law on the decision-making authority of municipal bodies and their provincial review boards will be examined in an effort to clarify, if possible, the question of whether land developmen…

  • Fear and Loathing in Jus Cogens

    Open Access•Eric A Morgan, Ed Morgan•ARTICLE•International Journal Canada s…•2008

We were somewhere around custom on the edge of the convention when the doctrine began to take hold.1 The purpose of this essay is to take a Hunter S. Thompson-like journey to the heart of international law, to circumvent the banality of the discipline-a place that is viciously overcrowded...where almost everybody seems vaguely happy2-and ascend the discipline's heights in search of norms that have profound meaning. Despite the attractiveness of s…

  • Orientalism and the Foreign Sovereign

    Eric A Morgan, Ed Morgan•ARTICLE•Israel Affairs•2007

It is nearly an article of faith in literary criticism and legal scholarship that Western considerations of Eastern societies demonstrate the drive toward, as Edward Said put it in Orientalism, “dominating, restructuring, and having authority over the Orient.” This essay revisits that question of West and East in two of its most prominent guises: medieval literature and modern law. It does so be examining two narratives, the first of which is Cha…

  • New Evidence

Open Access•Eric A Morgan, Ed Morgan•ARTICLE•Leiden Journal of International Law•2005

A war crimes trial embodies a combination of representational and presentational drama. The contemporary war crimes trial owes equal inspiration to the ‘realism’ of Henrik Ibsen and the ‘theatrics’ of Bertolt Brecht. The question for scholars is whether the trial is but a stylized presentation of the ‘real’ events, or a realistic medium through which to eavesdrop on history. This essay explores this question of war crimes and dramatization in the…

  • The Other Death of International Law

Open Access•Eric A Morgan, Ed Morgan•ARTICLE•Leiden Journal of International Law•2001

Lawyers have begun to think of the legal events and institution-building related to the demise of Yugoslavia as raising new hope for international law. The recognition of newly self-determining sovereign entities that was facilitated by the European Community, together with the creation by the UN Security Council of an international criminal tribunal, constitute instances of newfound political authority over political disputes. On the other hand,…
