Equality (Kafā’ah) in the Muslim Law of Marriage
This chapter is an attempt to discover only how far social stratification is reflected in the doctrine of kafa'ah (equality) in the Muslim law of marriage. An examination of the sources dealing with kafa'ah indicates the paucity of references to such a doctrine in pre-Islamic Arabia. Ibn Manzur defines kafa'ah in marriage as the situation in which the husband is equal to the wife in nobility, piety, lineage, family, etc. Hanafi jurists, on the ot…
Mulāzama or Harassment of Recalcitrant Debtors in Islamic Law

Compelling Defendant's Appearance at Court in Islamic Law
Different legal systems have employed a variety of measures to insure the appearance of the defendant in court. The earliest conception of an action in Rome and in pre-Islamic Arabia was the voluntary appearance of both parties before a recognized or prestigious authority. Thus, early Roman law could not pass judgment against a defendant who failed to appear, either voluntarily or involuntarily. The idea that the court could give a judgment in th…

Students of Middle East Studies in this country will, for generations to come, continue to sing the praises of the dean of American Arabists and Islamicists, who passed away last Christmas Eve. For there is hardly a scholar of the Middle East in this country whose academic career or intellectual development has not been directly or indirectly influenced by him, his students, or his many publications. There is hardly a center of Middle East studie…

Egypt in American Primary and Secondary School Literature: A Summary of the Final Report Submitted to the United States Office of Education
The social studies teacher in today’s elementary and secondary school is faced with a serious problem in attempting to determine the curriculum for a geography, cultures or history course: does one discuss each of the 145 or so independent states in the world, allowing only one hour of class period per country, or should particular attention be directed to certain nations? Of course, the latter is the only logical alternative. The problem remains…
