Grandparent contact
This article reviews the debate about the enhancement of grandparents’ legal status in relation to their grandchildren. In particular, it observes that calls for a legal presumption in favour of grandparent contact with their grandchildren when family relationships break down were emboldened by the enactment in s1(2A) of the Children Act 1989 of a presumption that involvement of both parents in their children’s lives furthers children’s welfare. …

Justifying the Laspo Act
This article examines the ways in which the radical cuts to legal aid in private family law cases were presented and justified by the then government. It is argued that the targeting of legal aid in these cases for austerity measures was legitimated and facilitated by a skewed interpretation of history; by the use of the neoliberal discourses of responsibility and autonomy; by minimising the importance of family disputes; and by means of negative…

Female Genital Mutilation
Contact Disputes
Incomplete Citizens
The image of the child as the victim of separation or divorce is well‐established in legal, socio‐legal and popular discourse. However, the authors argue, alongside this traditional image of the child, there is a different image of the child emerging, that of the autonomous, responsible child. This is apparent in academic discourse, policy documents and legal pronouncements. This child is included in the project of ‘remoralising’ the family by bu…
Grandparents and Contact
This article examines the legal position of members of the extended family involved in contact (access) disputes and locates the discussion within the debate about the utility of rights in resolving such disputes. In particular it focuses on Article 8 of the European Convention on Human Rights and also refers to the jurisprudence of the US Supreme Court
Domestic violence and divorce mediation
Both domestic violence and mediation have attracted considerable attention from academics and the public at large. However, the debate has focused on these issues as discrete and unconnected and it is only in recent years that they have been recognised as potentially interlinked. The question of whether disputes should be mediated where the partners have been involved in an abusive relationship has not, therefore, been high on the public agenda i…
The Contest between Culture and Gender Equality under South Africa's Interim Constitution
On 25 January 1994 South Africa's State President signed the new Constitution of the Republic of South Africa proclaiming a new order founded on the principle of equality.1 As is well known, this historic event was the culmination of four years of extraordinarily difficult negotiations. The text of the Constitution itself is the product of eight months of hard work and, at times, heated debate.2 Because it represents an accommodation between part…
Law Reform and the Family
One of the achievements of the feminist movement has been to draw attention to the violence women suffer both outside and inside the home. The ensuing debate has raised legal questions about the manner in which violence against women is policed, the definition of crimes, particularly rape, and appropriate penalties. A central issue has been the validity of the 'marital rape exemption', a legal rule found in many countries which exempts husbands f…
Rape in Marriage - Law Reform in Scotland and South Africa
A trend towards legal recognition of equality within marriage has led in a number of jurisdictions to a re-evaluation of the marital rape exemption. The most recent legal developments in relation to rape in marriage have taken place in Scotland and South Africa. However, change in these two jurisdictions has led to differing results. This note examines the decision of the Scottish High Court of Justiciary which abolished the immunity of husbands …
Grandparents and the Limits of the Law
Against a background of increased concern among lawyers and social scientists regarding access to children by persons other than parents, this article examines the relevant law in a number of jurisdictions. It notes both a trend towards strengthening the legal position of non–parents and a seeming reluctance in England to utilize existing rights. In the light of this and the growing emphasis on conciliation in resolving family disputes, the write…
