International Survey of Family Law 2018
In the case of Zorica Jovanovic v. Serbia, initiated before the European Court of Human Rights (ECtHR) in April 2008, the applicant complained of the continuing failure of the Serbian authorities to provide her with any information about the real fate of her son who had allergedly died while in the care of a state-run hospital or indeed with any other redress. Not only did the ECtHR \ndecide that the applicant's right to family life guaranteed by…
Christianity and Family Law: An Introduction. Edited by John Witte, Jr. and Gary S. Hauk
Religious contributions to family law could be relegated to history or extolled as showing what the family could and should be. This book gets full marks for the former, and the “historical figures speak for themselves” (p. xx). As the editors note, it “avoids strong methodological or disciplinary biases,” aiming at a general audience (p. xx-xxi). Their introduction succinctly describes each chapter, the reasons chosen for each principal figure o…

Reaching the Limit: Granting Insiders and Outsiders Rights
This chapter examines family autonomy from a more structural stance, as a network of relationships best calculated to create social capital for the couple and their children (as well as for society as a whole). It looks at what happens to social capital if insiders (spouses or children) are accorded (or seize) individual rights that conflict with well-functioning family networks. Instead of looking at invasions from above, the chapter considers a…
What Happens When Trust Fails? Mimetics in Families Gone Wrong
This chapter examines whether the social science and humanities literature on larger communities in trouble helps to explain troubled families and, if it does, whether similar legal or policy steps could prevent family violence. Some of the patterns others have explored for intracommunity crises might also apply to the less violent conflicts of divorce and early (involuntary) emancipation of children.

Finite horizons: The American family
In the summer of 1992, while I was reading and thinking about Martha Minow's latest book, I was struck with my double role as a responsible adult. Vacationing in the north woods of Wisconsin with my mother, I suddenly needed to care for her as well as my own small children. Generational connections, important before, swelled hugely in crisis. As I caught my breath between hospital runs and kids' activities, I was thankful that I had received so m…
Marriage and Opportunism
Spouse abuse is no longer a secret. It has become a thorn in America's conscience. Abuse even warranted a lengthy Supreme Court discussion in an opinion on abortion. It is certainly worth thinking about whether anything systemic caused the apparent outbreak of violence in the home. If there is a legal "fix" that would remove incentives to abuse, and therefore reduce the incidence of abuse at the margin, we should know about it. It is the thesis o…
