An Unexpected Member of the Mālikī muḫtaṣars list
This article addresses a work titled Tuḥfat al-ḥukkām fī nukat al-ʿuqūd wa-l-aḥkām (“A gift for judges”, book on delicate details of legal documents and judgments). Also known as al-ʿĀṣimiyya , this is a compilation of Mālikī legal maxims condensed in 1698 verses in raǧaz metre by the Andalusi scholar Abū Bakr Muḥammad b. Muḥammad b. Muḥammad Ibn ʿĀṣim (Granada 760/1359-829/1426). Apart from arguing why I think the Tuḥfa can be treated as a muḫta…
Coping with External and Internal Disintegration Forces
This article approaches Qāḍī ʿIyāḍ b. Mūsā’s contribution to the stabilization of Mālikīsm in the Islamic West through his characterization of three important Andalusī figures of the school: Ibn ʿAbd al-Barr, Abū l-Walīd al-Bāǧī and Abū Bakr al-Ṭurṭūšī. ʿIyāḍ’s biographies of these scholars in two of his works, Tartīb al-madārik and al-Ġunya , are compared with those of Ibn Farḥūn (d. 799/1397) in his al-Dībāǧ al-mu d hab. These biographical dict…
Is Maternity Determined by Pregnancy and Delivery? Five Andalusī Interpretations of Qurʾān LVIII,2
This article focuses on the use of Qurʾān LVIII ,2 by contemporary Muslim jurists in debates about surrogacy arrangements. As argued by Ayman Shabana in a rich article published in 2015, the majority of those jurists claim that Qurʾān LVIII ,2 provides an unequivocal legal definition of maternity and establishes that pregnancy and delivery provide the decisive criteria to determine whether a woman is the mother of a child instead of her contribut…
The Duration of Pregnancy in Contemporary Islamic Jurisprudence (fiqh) and Legislation
This article deals with assessments by a number of contemporary Sunni fiqh experts on the legal duration of pregnancy. Most of them strive to demonstrate that classical jurisprudence ( fiqh ) and modern medicine are perfectly compatible, despite the fact that the former contemplates gestational periods far longer than nine months. Also, they make proposals for national legislative bodies to best accommodate medical evidence to shari`a ’s ethical …
Redefining Paternal Filiation through DNA Testing
The social malaise produced by thousands of children born out of wedlock and abandoned is widely understood in the Maghreb. It has opened a breach in traditional Islamic legal discourses as well as social practices regarding the establishment of filiation in Tunisia, Morocco, and Algeria. Analysis of Islamic jurisprudence and opinions, court decisions, and state laws since 1999 shows that the crisis of abandoned children combined with the biologi…
Explicit cruelty, implicit compassion
In his seminal biography of Ibn Rushd al‐Ḥafīd, better known in the Latin West as Averroes (d. 1126 CE), Dominique Urvoy referred to the “Jewish” symbolism of Averroes’ confinement in Lucena, a city in today’s Spanish province of Cordoba. In this regard, Urvoy quoted the Maghribian historian ʿAbd al‐Malik al‐Marrākushī, according to whom the choice of Lucena was due to a rumour that Averroes had Jewish ancestors and that his family was not rooted…
Why Did the Scholars of al-Andalus Distrust al-Ghazāli? Ibn Rushd al-Jadd's Fatwā on Awliyā' Allāh
The reception of Ghazālī's thought in the Muslim West brought about a series of negative reactions that resulted in official condemnations of his books and eventually led to their public burning. According to the logician Ibn Ṭumlūs, the fuqahā ' appeared before the Almoravid amīr claiming that Ghazālī's books could lead Muslims to lose their faith, and thus recommended their burning. From other reports of the same event, one might infer the exis…
Muslims, Their Beliefs and Practices
Muslims, Their Beliefs and Practices is the revised 2nd edition of a previous work with the same title divided in two volumes: Vol. I, "The Formative Period," published in 1990, and vol. 11, "Contemporary Period," which appeared in 1993. The present issue, like the preceding one, is a synthesis of the development of Islam throughout its history, from the 7th to the 20th century, with an insight into the challenges of the future. The author makes …
