The regulation of animal welfare at the intersection of race, religion and species: The case of religious slaughter bans in European courts
European court decisions confirming Belgian bans on religious slaughter have been analysed primarily as clash between animal welfare and religious freedom. This article proposes a different reading that considers these bans as sites for constituting the ‘humane and civilised subject’ at the intersection of race, religion and species difference. It first situates contemporary bans within animal welfare legislation's longer history. It traces how r…
Religion and race: The need for an intersectional approach
Islamophobia, racial discrimination law, and the question of self-identification
Law and Jewish Difference: Ambivalent Encounters
After centuries of persecution and discrimination, Jews are today often seen as a successful and well-integrated religious minority group in a 'Judeo-Christian West'. This book qualifies this narrative by exploring the legacy of Christian ambivalence towards Jews in contemporary secular law. By placing disputes over Jewish practices, such as infant male circumcision and the construction of eruvin, within a longer historical context, the book trac…
Studying while Muslim: Anti-discrimination law, countering violent extremism, and suspect youth
As part of the global War on Terror, governments, including in Australia, have increasingly encouraged teachers to spot students ‘at risk’ of radicalisation, thereby turning schools into sites of surveillance. Despite their important intended goal, these programs have been criticised for leading to over-reporting, misinterpretation, and the stigmatisation of Muslim students who have been disproportionately affected by such surveillance practices.…
Law and the construction of Jewish difference
Despite the significance of the figure of ‘the Jew’ as Other in the Western imagination and the persistence of prejudice against Jews, there have been few studies of contemporary Jews as subjects of prejudice in liberal secular law and legal discourse. This article draws attention to continuing Jewish vulnerability and argues that a focus on colonial encounters and phenotype in understanding processes of legal exclusion based on religion and race…
The difference a wire makes: Planning law, public Orthodox Judaism and urban space in Australia
This paper considers a planning dispute that surrounded the construction of a Jewish religious installation (called an eruv) in the public urban space of an Australian suburb. The aim of this case-study is to examine the role of law in regulating Jewish difference – a topic that has to date received little attention in the socio-legal literature concerned with the governance of religious diversity. In analysing residents’ objections to the eruv, …
