Open Access•Martina Eckardt, Wolfgang Kerber•ARTICLE•European Journal of Law and…•2024

With the advance of smart IoT devices (Internet of Things) the amount of valuable data will increase dramatically. With its recently enacted Data Act (DA) the EU introduces new data access and sharing rights for the users of IoT devices. This article analyzes how the DA will change the bundle of rights on non-personal IoT data regarding who can control, access, use, share, and monetize this data. • Developing Two‐tiered Regulatory Competition in EU Corporate Law

Open Access•Martina Eckardt, Wolfgang Kerber•ARTICLE•Journal of Law and Society•2014•Cited by: 1

Since the Centros ruling in 1999, Europe has evolved a two‐tiered system of corporate laws. This opens up the possibility of some horizontal regulatory competition between the corporate laws of the member states. Following a draft regulation on the European Private Company (SPE), an additional legal form tailored to the needs of small and medium‐sized enterprises (SMEs) is being proposed. We analyse whether such a supranational European legal for…

Wolfgang Kerber, Martina Eckardt•ARTICLE•Journal of European Public Policy•2007•Cited by: 36•References: 51

This paper analyses the potential of the open method of co-ordination (OMC) and of laboratory federalism for policy innovation and learning in a multi-level system of jurisdictions. Our analysis shows that both can be seen as institutions that establish processes of generating and spreading new knowledge about appropriate public policies. However, the respective learning mechanisms are very different: in laboratory federalism learning takes place…

This paper analyses the potential effects of the open method of coordination (OMC) on pension reforms in the European Union. The main results are: (1) The OMC on pensions might foster yardstick competition by providing reliable benchmarks and by improving the quality and quantity of information about successful pension policies in other member states. However, remaining difficulties in defining indicators and with data availability have to be ove…
