  • Autonomous Decision-Making as a Challenge for Legal Research

    Klaus Heine•ARTICLE•Journal of Institutional and…•2025

In this contribution, the challenges that autonomous decision-making (AI) poses for law is approached by a review of the so-called »accountability gap.« To get a better understanding of the fundamental problem that economic analysis of law has with autonomous decision-making, different routes for solving the problem are scrutinized. The analysis shows that the toolbox of Law and Economics does not yet provide a clear answer. Doctrinal law can als…

  • Bridging the accountability gap of artificial intelligence – what can be learned from Roman law

    Open Access•Klaus Heine, Alberto Quintavalla•ARTICLE•Legal Studies•2024

This paper discusses the accountability gap problem posed by artificial intelligence. After sketching out the accountability gap problem we turn to ancient Roman law and scrutinise how slave-run businesses dealt with the accountability gap through an indirect agency of slaves. Our analysis shows that Roman law developed a heterogeneous framework in which multiple legal remedies coexist to accommodate the various competing interests of owners and …

  • Priorities and human rights

Open Access•Alberto Quintavalla, Klaus Heine•ARTICLE•The International Journal of…•2019•Cited by: 2

This article intends to further the debate about a possible hierarchy in the implementation of human rights. To this end, it proposes a theory which may serve as a stepping stone towards the achievement of shared and well-defined priorities, taking scarcity as a starting point to analyse the implementation of human rights. The proposed theory builds on the so-called Maslow pyramid which displays a common pattern of behaviour aimed at addressing p…

  • The dark side of price cap regulation

    Open Access•C Engel, Klaus Heine•ARTICLE•Public Choice•2017•Cited by: 1•References: 44

In a nutshell, price cap regulation is meant to establish a quid pro quo: regulators are obliged by law to intervene only at rare, previously defined points in time, and only by imposing an upper bound on prices; firms are meant to justify regulatory restraint by adopting socially beneficial innovations. In the policy debate, a potential downside of the arrangement has featured less prominently: the economic environment is unlikely to be stable w…

  • Several distinct wet periods since 420 ka in the Namib Desert inferred from U-series dates of speleothems

    Open Access•Mebus A Geyh, Klaus Heine•ARTICLE•Quaternary Research•2014

The scarcity of numerical dates of the arid areas in southern Africa is a challenge for reconstructing paleoclimate. This paper presents a chronological reconstruction in the central part of the Namib Desert, Namibia, for the last 420,000 yr. It is based on 230 Th/U dates (TIMS) from a large stalagmite and a thick flowstone layer in a small cave located in the hyper-arid central Namib Desert. The results provide for the first time evidence of thr…

  • Innovation, Tort Law, and Competition

Florian Baumann, Klaus Heine•ARTICLE•Journal of Institutional and…•2013

We examine the link between innovative activity on the part of firms, the competitive pressure to introduce innovations, and optimal damages awards. While innovative activity brings forth valuable new products for consumers, competitive pressure in the ensuing innovation race induces firms to launch innovations too early, thereby raising the likelihood of severe product risks above the optimal failure rate. Introducing innovations too early may c…
