Publication and the validity of constitutions in the Late Roman Empire
Contrary to the current view of Mommsen, Seeck and Schwind that imperial legislation required publication to gain validity, Bianchi Fossati Vanzetti and particularly Kreuzsaler maintained that imperial legislation gained validity directly by the issuing by the emperor (the datio ). Purpose of publication was merely to make the law known. For legal acts performed in the period between datio and publication according to the old law generally restit…
VI. The colonate in the west of Europe after ca. 500 AD
The colonate as it was established under Diocletian depended on the credit an estate owner provided to a farmer. The latter had to provide at any moment services instead of interest and consequently had to reside in or near the estate. If the credit was used for the poll tax and the credit agreement was inserted into the census of the estate, the colonate in its public law form was created. It involved also a change in the status of the colonus. …
Chirographs in Roman law: Constitutive or evidential
It has recently been sustained that chirographs had only evidential value and no constitutive effect in classical Roman law. That is correct regarding their origin in Roman law, however, the nature of a chirograph was such that as evidence it was effectively constitutive. Only the remedies later created (the exceptio and later the querimonia non numeratae pecuniae ) provided relief. They and the actiones utiles granted to acquirers of chirographs…

Article Arnaud Besson, Constitutio Antoniniana, L’universalisation de la citoyenneté romaine au 3e siècle (= Schweizerische Beiträge zur Altertumswissenschaft 52) was published on July 1, 2022 in the journal Zeitschrift der Savigny-Stiftung für Rechtsgeschichte: Romanistische Abteilung (volume 139, issue 1)
Could after the division of administration in 364 an emperor issue a law for the entire empire
The question whether the administrative division of the Roman empire in 364 or 395 implied also a divided legislation, i.e. that each part could or did legislate only for itself, has been extensively debated. To all appearances the emperors issued laws jointly, and likewise the prefects issued edicts jointly. Yet it is possible to deduce from the few relevant texts that these manifestations of unity were merely ideological: in practice each part …

Emanzipation als rite de passage
Emanzipation as rite de passage . Formula Visigothica 34 (7 th c.) describes an emancipation. The text suggests that sons of Romans had an expectation to be released in this way from the paternal power when they reached the age of majority. Emancipation was specifically dealt with in their law, the Lex Romana Visigothorum. Some of these do not figure in Justinian’s Code. They might fit the gap, otherwise filled by excerpts from the Theodosian Cod…

Die Schriftheimat von Vat. Reg. Lat. 886 (Codex Theodosianus libri IX-XVI)
It is generally assumed that the main manuscript of the Theodosian Code, Vat.Reg.Lat. 886, was copied in the 6th century in South-East Gaul, although Italy as provenance is not excluded. This manuscript contains marginal summaries, of which the origin is also attributed to Gaul. However, it can be shown that the largest group was made by one of the scribes (V2*) after 535 and before 554, on the very manuscript, that this was very likely done in R…

A note on the methodology of Seeck’s Regesten der Kaiser und Päpste
When reconstructing the sources of the Theodosian Code, it is useful to put the thesis, that local archives were used, to the test and reconstruct such a local archive on the basis of the addressee. It appears in the provided example that the letters must have been taken from the imperial copybook of outgoing letters. Further, Seeck reconstructed sometimes the place where a text was issued on basis of the itinerary of the emperor. In the example …
Causae adquirendi eius quod nostrum non sit (D. 41,2,3,21): ‘Rechtmäßiger Eigenbesitz’
The thesis that the causae adquirendi in D. 41,2,3,21 lead first of all to a ‘rechtmäßiger Eigenbesitz’ (justified possession) and not to ownership or acquisitive possession, as formulated by Pool, does appear not to hold upon examination of this text. The key text D. 41,4,2,1 on which his thesis that the title pro emptore implies such possession relies, does not imply more than factual possession. The causae of D. 41,2,3,21 refer, as the causa i…
Noxa caput sequitur
Generally it is assumed that caput in the phrase noxa caput sequitur refers to the delinquent slave or filius familias . The liability for the delict is attached to his person. It is argued, however, that caput refers to the pater familias of the delinquent. The Twelve Tables contained a rule on their direct and personal liability (with surrender to the autorities). The introduction of the edicts on furtum and the lex Aquilia , with the direct an…
The episcopalis audientia in Late Antiquity
The constitution Sirmondiana 1 of 331/3 is seen by a number of scholars as evidence that in the period 331/3–408 bishops had full jurisdiction, i.e. that even against the wish of one party, a case could be brought before his court and lead to an enforceable sentence (without, by the way, the possibility of appeal). Previous to and after this period this was only possible if both parties agreed, which reduces the bishop’s court to arbitration. How…
Furtum and manus / potestas
The nature of furtum has been subjected to various interpretations, often with the assumption that this delict changed in nature between the Twelve Tables and end of the 2nd century A.D. It is submitted here that the delict was originally an intrusion upon the power ( manus , potestas , dominium ) of the pater familias and in its most acute form ( furtum manifestum ) punished with a religious sanction, viz. treating the fur as sacer . The same sa…

The Colonate in Justinian's Reign
Justinian's codification may be considered a coherent aggregate of all the law existing in A.D. 530–534. On the basis of this and his subsequent legislation it appears that the condicio coloniaria existed in his reign in two forms. One, the adscripticiate, based on a contract by which a person fixated his origo from a town onto an estate. This implied his coming under the potestas of the estate owner and the treatment of his possessions as if pec…

The prodigal son
In Roman society we encounter the luxuriosus, the dissolute whose vice was, that he could not restrain himself and indulged in excessive behaviour: usually drinking and whoring. This phenomenon was not restricted to the Roman Society: We find it in Judea (the prodigal son), in Europe in the Middle Ages, throughout the 17th through 19th century, and in every period and society the response to this deviant behaviour differed (disinheriting and bani…
Lectures on the contemporary law
Legal science and law in Late Antiquity Gaul and Africa
Liebs has treated of legal science in Late Antiquity in two books, one on Africa, the other, recently reedited, on Gaul. As a result of his method we dispose now of valuable displays of the status quo , indicating that the level of jurisprudence was still acceptable; although regarding the Pseudopauline Sentences it is still unclear from which sources the author drew. Weßel, a pupil of Liebs', has analysed in detail the Tablettes Albertini , purc…

The slave who was slain twice: Causality and the lex Aquilia (Iulian. 86 dig. D. 9,2,51)
D. 9,2,51, in which a slave is slain twice and dies, and where Julian considers both assailants equally liable for killing, has been interpreted in the context of causa superveniens . In that case Julian's opinion becomes contradictory. It is argued that the text should be read in the context of the Stoic theories on causality as current among the jurists in the first centuries AD. In these theories there existed no causa superveniens as of the m…
