  • Entre História e Dogmática

Open Access•Manuel Bastias Saavedra, Camilla De Freitas Macedo et al.•ARTICLE•Direito Público•2024•References: 1

    Open Access•Manuel Bastias Saavedra•ARTICLE•Direito Público•2024

  • Norms beyond Empire

    Open Access•Manuel Bastias Saavedra•BOOK•Norms beyond Empire•2022

Norms beyond Empire seeks to rethink the relationship between law and empire by emphasizing the role of local normative production. While European imperialism is often viewed as being able to shape colonial law and government to its image, this volume argues that early modern empires could never monolithically control how these processes unfolded. Examining the Iberian empires in Asia, it seeks to look at norms as a means of escaping the often to…

  • Decentering Law and Empire

    Open Access•Manuel Bastias Saavedra•CHAPTER•Norms beyond Empire•2021

The Iberian empires in Asia set in motion a profound process of normative production and change. Whether it was in defining the relations between imperial polities, regulating social and religious life, establishing commercial treaties, organizing imperial or interstitial jurisdictions, or defining how inhabitants would be ruled, the presence of the Crowns of Portugal and Castile in Asia triggered an immediate need for regulation, provoking shift…

historian observe that which law does not? By understanding diversity as paradox, I will argue that a constructivist category of diversity will allow the legal historian to move between legal and non-legal sources without losing from sight the specificity of legal observation

By looking into sales of indigenous land in the territory of Valdivia between 1790 and 1830, this article discusses how legal interactions were tied to the local spaces of rural habitation. Since ownership was linked with possession and use in Spanish colonial law, local social relations and shared local knowledge were crucial for determining legal ownership and ensuring the validity of land transfers. This article provides insights into how law …

  • Do controle à reforma social

Open Access•Manuel Bastias Saavedra, Camilo Plaza Armijo•ARTICLE•Estudos Ibero-Americanos•2016

This article focuses on the circulation of ideas on social policies in Latin America through the discussions in the Latin-American scientific congresses. The main argument is that, although Latin-American scholars relied on European narratives to frame the social problems that affected the region, the policy solutions they found were not based on the direct importation of foreign models. Either by emphasising criminality or the need for social re…

Rumour Propagation as a Form of Social Control. A Case from Dictatorial Chile The following article discusses the role of media and civilian organisations in downplaying the role of rumour propagation in the Chilean dictatorship. After outright repression failed to control popular unrest during the national protests that took place between 1983 and 1984, the military regime attempted to keep people inside their homes by playing on their fears and…
