The American Society of International Law 1906–1956
The founding fifty years ago of a society to promote the establishment of international relations on the basis of law and justice was a step marking the progress that had been made at the beginning of the century in the age-long efforts to find a means of substituting reason for force in the settlement of international controversies. At that time arbitration was generally regarded as the most suitable and acceptable substitute for war. Great Brit…

The Need to Restrain the Treaty–Making Power of the United States within Constitutional Limits
“The treaty-making power is an extraordinary power liable to abuse. Treaties make international law and also they make domestic law. Under our Constitution treaties become the supreme law of the land. They are indeed more supreme than ordinary laws, for congressional laws are invalid if they do not conform to the Constitution, whereas treaty law can override the Constitution. Treaties, for example, can take powers away from the Congress and give …

The International Court of Justice
In this number of the J o u r n a l appears the twenty-fifth annual article by our colleague, Judge Manley 0 . Hudson, on what is popularly known as " The W orld Court." To publish twenty-five consecutive articles on any subject is a unique achievement for both the author and the publication which carries them. A quarter of a century's accomplishment is generally marked as a jubilee year and celebrated as such. A record of twenty-five years in th…
The Nuremberg Trial and International Law
Retribution for the shocking crimes and atrocities committed by the enemy during World War II was made imperative by the overwhelming demands emanating from the public conscience throughout the civilized world. Statesmen and jurists realized that another failure to vindicate the law such as followed World War I would prove their incapacity to make progress in strengthening the international law of the future. 1

James Brown Scott, 1866–1943
Sensing that it might be an epilogue, as in fact it turned out to be, to his life’s work, Dr. Scott on April 1, 1939, wrote in the preface to the last of a long list of legal and scholarly volumes which bear his name as author or editor, as follows: “For nearly half a century, from the time of entering Harvard College until the present day, I have been deeply interested in the fundamental conceptions of law and of the state; and in later years it…

The War in Europe
The great European conflagration which has been predicted for a number of years, and as to the causes, results and conduct of which volumes have been written, has at last come upon the world with amazing rapidity, when it was apparently least expected, and with inexpressible fury. Within less than two weeks from the time when it was first known that a possible casus belli existed between Austria and Servia, growing out of or induced by the assass…

Outline of a Plan for the Maintenance of International Peace, Based Upon the Progressive Development of Accepted Methods
International arbitration is the oldest and most favored method of settling disputes between nations when diplomacy fails. The Hague Conventions of 1899 and 1907 for the Peaceful Settlement of International Disputes both declare that “In questions of a legal nature, and especially in the interpretation or application of international conventions, arbitration is recognized by the Contracting Powers as the most effective, and at the same time the m…

In his last annual message President Taft thus described the diplomacy of his administration: “ The diplomacy of the present administration has sought to respond to modern ideas of commercial intercourse.
