Der schrittweise Bedeutungsverlust der Versteinerungsmethode
The petrification method (Versteinerungsmethode) is known as an Austrian constitutional peculiarity, both in terms of linguistic expression and methodological approach. The prevailing opinion assumes that it originated as a general method of interpretation of the Austrian Constitution in 1930 or 1952. Leading legal scholars have attested to it a triumphal march through interpretation in Austrian public law starting with the interpretation of comp…
How to Develop the EU Justice Scoreboard into a Rule of Law Index
In this Article we argue that rule of law indices are a powerful tool to detect ills in the rule of law of EU Member States. In order to explain how to improve the indices’ potential, we give a critical overview of the methodological issues of the four rule of law indices which we consider particularly instructive for our purpose. These are the indices provided by the Freedom House (“Freedom in the World,” FIW), the Bertelsmann Stiftung (“Bertels…
Informal Institutional Elements as Both Preconditions and Consequences of Effective Formal Legal Rules
Institutions are made up of the interplay of three components: (i) formal rules, (ii) actual practices, and (iii) narratives (the last two are referred to jointly as informal institutional elements). However, lawyers in post-socialist countries do not see law through institutionalist lenses, but often nurture a false and simplistic idea of the law: they consider it to be the sum of rules, often disregarding the actual practices of the rules’ addr…
The Enforcement of EU Law and Values
It is clear that the current crisis of the EU is not confined to the Eurozone and the EMU, evidenced in its inability to ensure the compliance of Member States to follow the principles and values underlying the integration project in Europe (including the protection of democracy, the Rule of Law, and human rights). This defiance has affected the Union profoundly, and this book dissects the essence of this crisis, examining its history and offerin…
Regional Defiance and Enforcement of Federal Law in Spain
This chapter analyses three cases of challenges to the federal law in Spain. These episodes can offer an ideal opportunity to consider the resources available to the Spanish constitutional system in order to impose compliance with federal law. The first issue under discussion is the so-called ‘Ibarretxe plan’, which initially consisted of the proposal for a ‘New Political Statute’ for the Basque Country, which was rejected by the Lower House of t…

The Stufenbaulehre (SL) is a central and founding element of the Pure Theory of Law (PTL). Most of the criticism on SL targets the idea of the basic norm (Grundnorm), however unjustified. This criticism stems from a misunderstanding of the presumptive character of the basic norm and of the whole legal order. Others have criticised the relativisation of the difference between individual and general norms, Kelsen’s monism, and the determination of …
