Territorial Disputes and Their Resolution in the Recent Jurisprudence of the International Court of Justice
The workload of the International Court of Justice in recent years has increasingly featured cases of disputes classified either as ‘territorial disputes’ or as ‘boundary disputes’, or otherwise involving the Court in considerations of the law relating to acquisition or transmission of territory, or to the creation, location and effect of territorial frontiers. The present survey analyzes the contributions to international law of the Court's deci…
The International Court of Justice
The International Court of Justice (ICJ or the Court) continues to hear and determine the contentious cases submitted to it, keeping up what has been referred to as an acceptable ‘cruising pace’. The question of the legal propriety of such contribution is examined, on the basis of a distinction between the task of decision, and that of expression of the decision. Some remarks are also offered on draft…
Case Analysis
The provisions of the ICJ Rules of Court concerning counter-claims have fallen to be applied in two recent cases, in circumstances such the Court has had to examine the nature of a counter-claim and the conditions for its admission as such, and in particular the nature of the ‘direct connection’ with the subject-matter of the application, required by the Rules. In each case the counter-claim was admitted, over the dissent of some judges: these de…
Dilemma or Chimera?—Admissibility of Illegally Obtained Evidence in International Adjudication
Procedural law on the international plane, especially the law applicable to international judicial proceedings, has long tended to be the poor relation of substantive law. In particular, insufficient attention has often been paid to its sources, and to the manner in which it may be created; and confident assertions tending to confuse the Sollen with the Essen, lex lata with lex ferenda , have been made with a frequency not to be expected in other…
