Mind the gap
Article 2(4) of the UN Charter prohibits the use of force in international relations and separately bans any threat of force, whether explicit or implicit. However, what constitutes an implicit threat remains ill-defined, undermining the UN Charter’s system of collective security. This article addresses the central question: How can implicit threats be more reliably identified? It begins by reviewing the incomplete work of the International Law C…
Synergy‐as‐principle in global climate regulation
Isolated policy interventions are unlikely to effectively address a highly complex and cross‐cutting issue such as climate change. Such issues require more integrated or holistic approaches. The concept of searching for synergy across multiple objectives could then achieve better outcomes than a default position of trade‐off and collision. Der Brexit als radikales Experiment
The 4th edition of the first volume of this work provides an update of the commentary on the preamble and articles 1 to 19 in case law and literature. The structure of the book has been retained and its content supplemented by more recent developments, such as the implications of Europeanisation and digitalisation as well as the Corona pandemic. As of the 4th edition, Frauke Brosius-Gersdorf has taken over the editorship of the commentary.

Through the joint ‘North Seas Countries Offshore Grid Initiative’ the states bordering the North Seas are establishing shared large-scale offshore electricity infrastructure in order to exploit their offshore wind energy resources. The article argues that this international governance of oceans space comes about legally because international law, European law and national law each fulfil a specific function. The climate regime provides the normat…
