Confronting the Challenges to Multilateralism in Times of Crises
Imitation as Flattery
This article analyses the United Kingdom’s (UK) ‘trade continuity programme’. The promise that, once outside the European Union (EU), the UK would strike new, lucrative trade deals continues to be an important part of the Brexiteers’ narrative. What the UK was compelled to do first, however, was to conclude ‘roll-over’ agreements to replace the trade agreements already made by the EU. This article posits that, contrary to expectations, the UK’s c…
The European Union and the governance of contested Global Spaces
Most of the areas which are beyond national jurisdiction have increasingly become contested, not least because of their growing importance and the recent ‘return’ of geopolitics. Their boundaries are blurred, and their governance has not been settled. The European Union (EU) is developing strategies to contribute to the governance of these areas: the high seas, the polar regions, the atmosphere, outer space, and cyberspace. Its roles remain, howe…
EU law and the governance of Global Spaces
This article addresses the question of how the EU's legal constraints can be overcome in the governance of Global Spaces. It shows, first, that EU law is part of a trend of including language relating to Global Spaces in constitutional documents. The article subsequently highlights a tension specific to the EU as a non-state entity. While the EU Treaties enshrine grand foreign policy ambitions, which are impossible to achieve without a proactive …
Brexit, the EU-UK Withdrawal Agreement, and Global Treaty (Re-)Negotiations
The withdrawal of the United Kingdom from the European Union has prompted a global recalibration of treaty relations. Due to the Withdrawal Agreement and its transition period, the UK is expanding its international treaty-making powers as it is gradually released from the constraints of EU law. Practice to date shows the creation of many new international legal instruments through which governments have sought to address the novel questions that …
Just Security in an Undergoverned World
This book is about how humankind can manage global problems to achieve both security and justice in an age of antithesis. Global connectivity is increasing, visibly and invisibly—in trade, finance, culture, and information—helping to spur economic growth, technological advance, and greater understanding and freedom, but global disconnects are growing as well. Ubiquitous electronics rely on high-value minerals scraped from the earth by miners kept…
Intervention and Peace Operations
The hybrid and transnational nature of current conflicts poses one of today’s most pressing global security challenges, with crises ranging from western Africa to the Himalayas. This chapter evaluates the policies, strategies, and mechanisms in place in conflicts that encompass transnational security threats such as terrorism, organized crime, and cross-border sectarian insurgencies in the context of UN peace operations. International efforts aim…
EU Foreign Relations Law as a Field of Scholarship
EU external relations law is a doubly peculiar field of scholarship that has attracted significant scholarly attention over the last several decades. It is both part of EU law—considered a “ new legal order ” distinct from international law—and it is concerned with the European Union as a global actor, a “ strange animal ” in that the EU is neither a state nor a classical international organization
Just Security and the Crisis of Global Governance
Pursuing security and justice jointly in global governance will be vital to human progress in the twenty-first century
From Speciality to a Constitutional Sense of Purpose
After the Lisbon Treaty, the objectives of the European Union are more numerous and ambitious than ever. But what is their importance and function within the ‘thickening’ legal order of the EU? Combining insights from both the law of international organizations and comparative constitutional law, the article traces the diverging role of objectives for, on the one hand, a traditional international organization marked by the principle of ‘specialit…
