    Open Access•Oliver Diggelmann•ARTICLE•Global Constitutionalism•2018•References: 5

In this contribution, the key elements of the book’s progress narrative will be discussed. The focus will be set on the ‘backbone’ of the book, which consists of three ideas or elements: the periodisation decision (II), the claim of a specific conception of social change (III), and a specific understanding of international law (IV). In regard to each of those elements it will be asked how they are justified, what insights they provide and whether…

  • How the Right to Privacy Became a Human Right

Oliver Diggelmann, Maria Nicole Cleis•ARTICLE•Human Rights Law Review•2014

The right to privacy became an international human right before it was a nationally well-established fundamental right. When it was created in the years after World War II, state constitutions protected only aspects of privacy such as the inviolability of the home and of correspondence. This article analyses how the integral guarantee—the right to privacy or to respect of one’s private life—came into existence. It traces the drafting history on t…

  • How is Progress Constructed in International Legal Scholarship

Tilmann Altwicker, Oliver Diggelmann•ARTICLE•European Journal of International…•2014•Cited by: 9•References: 4

There is a tendency in international legal discourse to tell the story of international law as a story of progress. 'Progress' is a concept which is tied to the process of secularization and Western 18th and 19th century philosophy. It still inspires the debate on international law – despite all setbacks in 'real history'. This article argues that progress narratives in the international legal discourse are constructed by – more or less subtle – …
