Avoiding or pursuing gender just transitions
The primary focus of gender just transition has been on the nature of work. But what is the role, if any, of law in this process? This article explores an under examined legal concept, the standard of review, through the lens of the landmark judgment, KlimaSeniorinnen Schweiz v Switzerland, from the European Court of Human Rights. It argues the Court’s innovative with respect to the standard of review, creating an interrogative and deferential st…
Advancing Wrist‐Worn Accelerometry for Measurement of Infant Motor Behavior
Wearable sensor technology, particularly accelerometry, is an emerging tool to measure infant motor behavior. We evaluated (1) differences and relationships between accelerometry‐derived variables in structured versus unstructured contexts and (2) the convergent validity of accelerometer‐derived variables with coded motor behavior during structured motor tasks and with caregiver reports of infant motor behavior. Typically developing infants ( n =…
Might makes right
In a decision which once again legitimates discriminatory welfare cuts, the UK Supreme Court has unanimously upheld the so-called ‘two-child limit’ for eligibility for child tax credit. The case co
Palliation or protection
This article examines what role equality law can play in addressing the inequalities created and exacerbated by the British government’s response to the Covid-19 pandemic. We argue that while there is great potential in existing legislation, there is a need for both policy-makers and courts to apply a more searching and nuanced understanding of the right to equality if this potential is to be realised. We begin by examining how the burdens of con…
Monitoring Women's Socio-Economic Equality under the ICESCR
Little attention has been paid to the monitoring tools of women's socio-economic rights (SER). Can the established monitoring tools used by the Committee on Economic, Social and Cultural Rights (CESCR) be reformed to detect all of the ways women's SER are undermined or is it more conceptually sound to establish a new gender equality monitoring standard? This article argues for both approaches. Incorporating a gender equality framework into tradit…
Women's Rights and the Convention on the Elimination of all Forms of Discrimination Against Women
There are a growing number of individual decisions under the OP-CEDAW. This article explores how to fully unlock the potential of the OP-CEDAW. I will argue that the individual decisions should be understood as opportunities to resolve the individual claim and make contributions to the evolution of CEDAW and women's human rights. The article proposes an analytical framework derived from the definition of discrimination in article 1 of CEDAW to ac…
The challenges of girls’ right to education
The United Nations human rights framework offers new ways of conceptualising sex education. Although none of the treaties explicitly refer to sex education, an analysis of the rights contained in the core treaties demonstrates that there is a positive obligation on the state to provide sex education to fulfil the human rights of girls and women. A human rights perspective offers a framework in which to address the challenges to delivery of sex ed…
Transformative Equality
It is generally agreed by most observers that the Millennium Development Goals (MDGs) have fallen short of achieving gender equality and women's empowerment. Today, women continue to be more likely than men to live in poverty, and more than 18 million girls in sub-Saharan Africa are out of school. One of the crucial reasons for the failure of the MDGs in relation to women was their inability to address the deeply entrenched and interlocking facto…
Cedaw and Women’s Intersecting Identities
CEDAW is committed to eliminating all forms of discrimination and achieving gender equality so that all women can exercise and enjoy their human rights. This article argues that this implicitly includes a commitment to understanding and addressing intersectional discrimination. Women experience disadvantage and discrimination based on their sex and gender and that is inextricably linked to other identities, factors and experiences such as a race …
