Associating or Disrupting
Association Martijn was a Dutch association that provided a platform for discussing a liberal attitude regarding sexual contacts between adults and children. One of the issues to consider regarding its dissolution is whether its activities amounted to a disruption of society. The European Convention on Human Rights (ECHR) is instrumental in understanding this case, inter alia since it was an integral part of the Dutch Supreme Court’s ruling. This…

The Religious Nature of Ethics
This paper analyses the nature of ethical concepts, views, and theories and inquires in particular to what extent they may be considered religious. The analysis is not limited to the religious aspects of specific religious worldviews (such as Christianity). The concepts ‘good’ and ‘dignity’ are examined as representative examples. This is a meta‐ethical issue, which may profitably be explored by examining the positions of representatives of moral…
Existential Suffering as a Legitimization of Euthanasia
Several countries have legalized euthanasia on the basis of medically diagnosable suffering over the last decennial; the criteria to which they adhere differ. The topic of this article is euthanasia on the basis of existential suffering. This article presents a recent proposal to legalize euthanasia for people who experience such suffering and then discusses the issue of what the value of life may be, and whether the standard that life is normall…
Laïcité
The meaning of “laïcité” has gradually changed from the principle that the state should abstain from interfering in citizens’ lives with respect to religious matters to the idea that citizens themselves have an obligation to desist from publicly manifesting themselves religiously. French citizens were first forbidden to display religious symbols or apparel in public schools; this restriction was subsequently extended to the public space. Most cit…
Blasphemy in an Age of Corroding Secularity
‘Sacred’ may be defined in various ways, depending on one’s worldview. In a pluralistic society, a single perspective from which to decide what is sacred seems absent. Yet certain elements are taken to be sacred such that they transcend individual worldviews. Their inviolability entails blasphemy laws, where ‘blasphemy’ extends beyond what is traditionally considered religious, since ‘religion’ itself is not clearly demarcated either. The interes…
Mitigated Democracy
Militant democracy is an attempt to defend democracy against totalitarian parties that would use democratic procedures to rise to power. This article is focused on the consistency of the concept of ‘militant democracy’. I argue that what militant democracy defends is not the democratic procedure itself but rather certain rights and the rule of law, and that those elements may in fact be compromised by democracy. This applies both if the democrati…
Basic Equality as a Post-Revolutionary Requisite
The task to reshape governments in the countries confronted with the Arab Spring prompts the question whether there are necessary conditions to realize a stable society that simultaneously seeks to eliminate the elements that have led to the uprisings. Acknowledging some constitutional rights seems indispensable in such a process. I argue that such a state of affairs is indeed the case, at least now that the ‘old’ justifications to differentiate …

Basic equality as a post‐revolutionary requisite
Purpose The Arab Spring poses challenges to governments of the countries involved; the author aims to present a way to respond to them. To this end, the notion of “basic equality” is proffered as a decisive element to be realized in a democratic form of government, democracy itself being necessary if one seeks to evade a return to the former forms of government. Design/methodology/approach No single answer suffices to realize stable while general…
Concerning Darwinism
Darwinism has become an encompassing theory, leaving the confines of science and accounting for all aspects of life. Such an outlook entails important consequences for the evaluation of life. In particular, organisms are considered mere means for species’ preservation and development, while reason is no special faculty, but rather an outgrowth of functions that are rudimentarily present in animals. Darwinism cannot, for that reason, be said to be…
Conceitualizando significado
A Systematic Interpretation of Hobbes’s Practical Philosophy
Hobbes’s political philosophy departs from a number of premises that are supposed to be self-evident, supplemented by various observations from experience. These statements are examined critically and in their interrelatedness in order to find out to what extent Hobbes provides a convincing system of thought. The importance of the basis of man’s actions, his self-interest, is inquired, since it serves as the basis of his practical philosophy. Aft…
