Dislodging the compulsory dispute settlement mechanism
Article 281 of UNCLOS allows states parties to a dispute to set aside the compulsory dispute resolution procedures under Section 2 of Part XV. This article discusses the recent jurisprudence that appears in the interpretations of Article 281. It discusses in turn whether, first, Article 281 provides requirements for agreements under Article 281(1) to activate the opt-out procedure from the compulsory dispute settlement mechanism; second, whether …
De Novo Delimitation Lines
The delimitation process has conceptually been considered to reflect preexisting maritime boundaries. This arises as the delimitation has not been seen to result in de novo lines as the delimitation process has been conceived as a declaratory exercise that necessarily arises from the ab initio nature of coastal States’ rights to the continental shelf. The International Court of Justice and Annex VII arbitral tribunals have followed a declarative …
Assertions of Entitlement to the Outer Continental Shelf in the Central Arctic Ocean
The legal and technical issues relating to the outer continental shelf entitlements in the Central Arctic Ocean present several challenges, most of which are to be resolved in accordance with Article 76 of the United Nations Convention on the Law of the Sea. Recently, two coastal States in the Central Arctic Ocean have made fully fledged submissions relating to the Arctic to the Commission on the Limits of the Continental Shelf. Russia has made a…
Agreed Minutes on the Delimitation of the Continental Shelf beyond 200 Nautical Miles between Greenland and Iceland in the Irminger Sea
The Agreed Minutes provide a method for identifying the relevant area for the purpose of delimiting the area of overlap. While the apportioning ratio delimiting the area of interest is fixed at a level, the delimitation line is subject to possible adjustments in light of the recommendations of the Commission. Indeed, the identification of the area of overlapping entitlement is rendered contingent upon the relevant recommendations of the Commissio…
The Ambit of Pactum de Negotiatum in the Management of Shared Fish Stocks
The United Nations Convention on the Law of the Sea provides for a mechanism pursuant to which coastal States, having an interest in the fishery of a shared fish stock which straddles its maritime areas under national jurisdiction is obligated to undertake negotiations on joint conservation and management measures with the other relevant coastal States. Despite the evident benefits which arise from a joint conservation and management agreement, w…
The Terms of Reference of the Commission on the Limits of the Continental Shelf
The Commission on the Limits of the Continental Shelf is neither fish nor fowl. Its primary purpose is to consider coastal states’ proposed limits of the outer continental shelf and to make recommendations thereto. Albeit the establishment of the outer limits is an act within the sole discretion of a state, the role of the Commission in the establishment of such limits is of pivotal importance. Due to its mandate, it can reasonably be argued that…
Catch Me if You Can
The objective of the compliance procedure is to ensure prompt compliance with the Dispute Settlement Body's (DSB) recommendations and rulings through an expeditious procedure. In their assignment, the compliance panels are faced with competing considerations of, on the one hand, ensuring Members the right of a “reasonable period of time” for implementing the DSB's recommendations and rulings and, on the other, ensuring prompt compliance. Complian…
