The Dynamics of Japanese Military Justice and the Maintenance of Order in the Philippines, 1942-5
Maintaining order in occupied territories was considered vital to the wider success of the Japanese wartime effort during the Asia-Pacific War (1937–45). Efforts to establish peace in the Philippines after occupation of the islands in January 1942 were impeded by the emergence of widespread guerrilla resistance. The Japanese military employed a variety of pacification and subjugation measures to combat opposition and restore order. Perhaps the mo…
Military justice on trial: Insights from efforts to prosecute Japanese commanders for “denial of fair trial” in the aftermath of the Second World War
The Second World War drew attention to diverse forms of military violence and the devastating impact of wartime, especially wartime occupation, on civilian populations. While the post-war trials that followed have often been remembered for establishing codified protections for civilians during conflict, they also offer a rare window into the mechanisms of military rule. Trials dealing with the so-called “denial of fair trial”, for example, shed l…
An Instrument of Military Power: The Development and Evolution of Japanese Martial Law in Occupied Territories, 1894–1945
The Imperial Japanese Army imposed martial law ( gunritsu ) in areas occupied during each of the full-scale conflicts it fought between 1894 and 1945. This article traces changes and continuities in the purpose, function, and content of martial law during the First Sino-Japanese War, the Russo-Japanese War, and the Asia-Pacific War to advance our historical knowledge of a much-understudied aspect of Japanese warfare. In so doing, it details the d…
First Essentials of Survival’: Ensuring the Support and Compliance of Civilians in the Guerrilla Conflict with Japan on Panay, 1942–1945
This article offers a detailed examination of the strategies employed by the resistance leadership in Panay to mobilize and, if necessary, coerce civilians into supporting them in their guerrilla conflict with Japan. It argues that their ability to adapt and, thereby, continually ensure the support and compliance of the civilian population were as important, if not more so, to their overall success than strictly military accomplishments. The prim…
An Island of Killing and Slaughter: Anti-Guerrilla Warfare and Civilian-Targeted Violence in Panay, 1943
Between July and December 1943, Japanese forces in Panay, the Philippines, perpetrated large-scale and widespread atrocities that deliberately targeted the civilian populace of the island. Houses were burned, crops destroyed, livestock slaughtered, and thousands of civilians of all ages and genders were killed. These atrocities were employed strategically as part of an anti-guerrilla campaign designed to compel civilians to give up their support …
Liberat[ing] Mankind from such an Odious Scourge: The Genocide Convention and the Continued Failure to Prevent or Halt Genocide in the Twenty-First Century
Since it came into force in 1951, the United Nations’ Convention on the Prevention and Punishment of the Crime of Genocide, a document created with the explicit purpose of "liberat[ing] mankind from such an odious scourge," has largely failed to deliver on the promises it enshrined. The twentieth century bore witness to an increasing frequency of genocides, a pattern which is continuing into the twenty-first century with the outbreak of arguably …
