  • Truly General Jurisprudence

    Open Access•Felipe Jiménez•ARTICLE•Legal Theory•2026

There has been a recent turn toward a new form of nonpositivism in Anglo-American jurisprudence. This paper focuses on the theories articulated by Mark Greenberg and Scott Hershovitz (I label their views as the “New Legal Anti-Positivism” or NLAP). NLAP argues that questions about legal rights and obligations are moral questions; that legal reasoning is a form of moral reasoning; and that there is no domain of legal normativity that stands indepe…

  • Relational Justice and the Value of Private Law

    Open Access•Flaco Jimenez, Felipe Jiménez•ARTICLE•Law and Philosophy•2026

Relational Justice: A Theory of Private Law articulates a distinctive theory of private law that claims this body of law is grounded in a basic commitment to self-determination and substantive equality. In this short comment, I focus on three aspects of Dagan and Dorfman’s theory: the relationship between relational justice and other more traditional notions of interpersonal justice; the idea that private law is intrinsically valuable; and the co…

  • Perceived risk and acceptance of automated vehicles users to unexpected hazard situations in real driving conditions

    Elisa Pérez–Moreno, Elisa Pérez-Moreno et al.•ARTICLE•Behaviour and Information…•2025

The decision-making systems in highly automated vehicles use artificial intelligence (AI) techniques to replicate human-like behaviour in driving. However, when studying the acceptance of such vehicles, analysing the human factor is essential if their deployment is to be a success. This paper presents an analysis, based on real driving conditions, of perceived risk and occupant acceptance of an SAE level 4 automated vehicle (where the user adopts…

  • Legality and Commitment

    Open Access•Felipe Jiménez•ARTICLE•Journal of Ethics and Social…•2025

Many philosophers believe there is no general, content-independent duty to obey the law. Yet at least some (and perhaps many) citizens and officials believe law makes a real difference—independently of its content and of prudential considerations—regarding what they should do. This paper offers an argument that vindicates the latter belief, even if skeptics are right in thinking that law cannot generate a general duty to obey. Under this argument…

  • Private law legalism

    Felipe Jiménez•ARTICLE•University of Toronto Law Journal•2024•References: 54

Judges decide multiple types of disputes, including disputes involving the property or contractual rights of two private parties (their ‘private rights’). The nature of these private rights has long been the focus of philosophical debates between conventionalists, non-conventionalists, and Kantians. In this paper, I offer an argument in favour of the adoption of a legalist concept of private rights by judges and lawyers involved in private law di…

  • Legal Positivism for Legal Officials

Open Access•Flaco Jimenez, Felipe Jiménez•ARTICLE•Canadian Journal of Law &…•2023

This paper makes a conceptual prescription: it argues that judges and lawyers should adopt a positivist concept of law, on normative grounds. The positivist view, I will argue, is more consistent with reasonable disagreement and majority rule than nonpositivist views, offers a better view of law’s moral standing, and is more consistent with what Dworkin called ‘integrity’ than non-positivism. As the paper explains, this is an argument about what …

  • Contracts, markets, and justice

    Felipe Jiménez•ARTICLE•University of Toronto Law Journal•2020•Cited by: 1•References: 28

Peter Benson’s Justice in Transactions offers a compelling internal, non-instrumental Hegelian conception of the law of contracts. It also connects this non-instrumental conception with broader issues like the social theory of the market, liberal justification, and socio-economic justice. The book is a remarkable achievement. As such, it will – and should – become part of the canon of contract theory. In this review essay, I focus on the theoreti…
