Language Model Interpretability and Empirical Legal Studies
Large language models (LLMs) now perform extremely well on many natural language processing tasks. Their ability to convert legal texts to data may offer empirical legal studies (ELS) scholars a low-cost alternative to research assistants in many contexts. However, less complex computational language models, such as topic modeling and sentiment analysis, are more interpretable than LLMs. In this paper we highlight these differences by comparing L…
Valuing Diversity
Other things being equal, worlds with greater diversity of subjective experiences are better than worlds with less diversity of experiences. This is the claim of the heteric welfarist. Such a view adds the diversity of experiences to the traditional welfarist concerns of aggregate well-being and the distribution of well-being over persons. The heteric welfarist could endorse the conservation of endangered species and the protection of threatened …
Presidential Transitions and Interests Group Participation in the Notice and Comment Process
Federal administrative agencies are one of the primary policymaking venues in the United States. One of the core features of U.S. administrative practice is the notice-and-comment process in which agencies solicit, collect, and respond to comments from the public before issuing new regulations. In this paper, we develop a model of commenting based on three motivations—litigation preservation; agency persuasion; and expression—and analyze public c…
Selection Bias and Causal Inference in Empirical Studies of the U.S. Courts of Appeals
Are Lawyers’ Case Selection Decisions Biased? A Field Experiment on Access to Justice
The attorney-client relationship is pivotal in providing access to courts. This paper presents results from a large-scale field experiment exploring how demographic information (encoded in potential clients’ names) affects how attorneys respond to initial inquiries in private injury cases. On the basis of prior literature, we hypothesize that race is a significant factor, but we also explore race and gender interactions. We find that ostensibly B…
Reviving Rationality
Reviving Rationality: Saving Cost-Benefit Analysis for the Sake of the Environment and Our Health explains how Donald Trump destabilized the decades-long bipartisan consensus that federal agencies must base their decisions on evidence, expertise, and analysis. Administrative agencies are charged by law with protecting values like stable financial markets and clean air. Their decisions often have profound consequences, affecting everything from th…
Computational Methods in Legal Analysis
The digitization of legal texts and advances in artificial intelligence, natural language processing, text mining, network analysis, and machine learning have led to new forms of legal analysis by lawyers and law scholars. This article provides an overview of how computational methods are affecting research across the varied landscape of legal scholarship, from the interpretation of legal texts to the quantitative estimation of causal factors tha…

Regional variation, holdouts, and climate treaty negotiations
We develop a model of international agreements to price a transboundry externality and provide a new heuristic to aid in interpreting negotiation behavior. Under conservative assumptions, a country’s net benefits will be positive under an efficient pollution price if its share of global damages is less than half its share of worldwide abatement costs. We solve for a permit allocation scheme consistent with that heuristic such that every region wi…
