Possessory Remedies in Late Medieval Frisian Law Texts
This contribution examines possessory protection in Frisian law texts from the late Middle Ages. These sources show that such protection was an old and fundamental principle. The jurists associated it with the possessory remedies of learned law, i.e., the Roman law interdicts and the canon law actio spolii . In the fifteenth century a certain preference for the latter remedy emerged. There is no trace of French remedies, such as maintenue and com…
In memoriam Margaret Louise Hewett, 1934-2022
February 18, 2022, was an authority in South Africa on the 'Old Authorities' of Roman-Dutch law, an expertise that has nowadays almost vanished. The serious health problems Margaret had experienced in recent years meant she needed care from late 2021, when her husband Jeremy died, and her health started going rapidly downhill in early February 2022.Margaret was born in Johannesburg in 1934 and moved with her family to Cape Town in 1949.In 1952, sh…
Teaching Roman Law in the 21 st Century
Can Roman law still be a useful part of the compulsory curricular programme for legal education in the Netherlands? At the beginning of the nineteenth century Roman law taught the student a further systematization of private law. Later it was seen as an introduction to present-day private law, irrespective of whether it was taught in a pandectistic or a more historical way. For the second half of the twentieth century three divergent approaches c…
The Gloss to the Saunteen Kesta (Seventeen Statutes) of the Frisian Land Law
The Seventeen Statutes is one of the oldest classical texts of Old Frisian Law. In its late fifteenth century edition, as part of the Frisian Land Law, it was provided with Latin glosses. Analysis of these glosses, which were scarcely investigated until now, enables us to pronounce with more certainty upon the date of both the Frisian Land Law, as a compilation, and its Gloss. Moreover, the glosses to the Seventeen Statutes reflect a considerable…

On the origin of the constitution Alearum lusus (C. 3,43,1) and its insertion into the Codex Justinianus
The article explores the origin of C. 3,43,1, which is a Latin epitome ( Alearum lusus ) of an originally Greek constitution of Justinian’s. The main issues discussed are when this constitution was translated, epitomized and by whom and when it was inserted in book III of the Codex. This is done by investigating the traces of the approximate times when the influence of the constitution in legal doctrine is apparent, both in civil and canon law. F…

Pre-contractual duties to inform in Early Modern Scholasticism
This paper seeks to highlight the early modern scholastic contribution to dealing with the issue of pre-contractual duties to inform. Bringing together different strands of thought, ranging from Aristotelian philosophy to Roman law, the 16th and 17th century scholastics developed adequate analytical tools to solve legal and moral problems arising from information disparities between contracting parties. While first looking at the different classi…
