Deportation of aliens from South Africa
Ad concilianda vulgi studia II
Ascended to power after the violent end of his predecessor, Claudius, as a Claudian without any ties of family nor adoption with the imperial Julian gens, was confronted by several problems, foremost among them the need to face the aftermath of his nephew Caligula’s assassination by both repudiating the act per se and its perpetrators and minimising its consequences through a general amnesty and the decision to simply but efficaciously skirt the …
Fleeing a Well-Founded Fear of Persecution to Be Persecuted Again? The Case of LGBTIQ+ Refugees and Asylum Seekers in Uganda
This work focuses on the legal promotion and protection of the rights of LGBTIQ+ asylum seekers and refugees in Uganda. Uganda’s treatment of LGBTIQ+ communities is one of the harshest in Africa, with the adoption of legal instruments criminalizing LGBTIQ+ people, as well as same-sex relations. These instruments apply to all LGBTIQ+ people present in Uganda, including asylum seekers and refugees. Refugees have never been granted refugee status on…
Ad concilianda vulgi studia I
Son to an allegedly poisoned father and an exiled mother, brother to two hostes populi Romani, Caligula, at his accession after the death of Tiberius in March AD 37, found himself in a tottering situation. However, the historiographical accounts underline the rejoicing of all Roman social strata at the rise to power of Germanicus’ son after the abuses suffered by his family, as everyone expected him to emulate his father’s greatness. Caligula was…
One Step Forward, Half Step Back
This work sheds light on the still unresolved plight of statelessness in Madagascar, a country that has a long history of stateless communities, above all among Karana, of Indian origin and Muslim religion. In spite of several important steps undertaken in order to eradicate stateslessness in the country (see, for example, the adoption of the 2016 Law on Nationality that partially amendended the 1960 Code on Nationality) the path for the complete…
Migrant Smuggling in Africa
This paper focuses on the plight of smuggling of migrants in Africa. Migrant smuggling has been documented along at least five major and several smaller routes in Africa. In my study, I investigate whether current legislation and policies are effective in curbing the practice of smuggling in Africa. To evaluate the success rate of these measures, I am comparing figures over recent years to establish whether there has been a decrease in the number…
Climate-induced displacement in the Sahel
This article examines legal aspects of climate-induced forced displacement in the Sahel region of North Africa. The Sahel region is being adversely affected by climate change, leading to the displacement of thousands of people, both cross-border migrants and internally displaced persons (IDPs). The conventional stance is that refugee status does not extend to individuals displaced as a result of natural or environmental catastrophes and that cons…

Asylum-Seeker and Refugee Protection in Sub-Saharan Africa
It is not often acknowledged that the great majority of African refugee movement happens within Africa rather than from Africa to the West. This book examines the specific characteristics and challenges of the refugee situation in Sub-Saharan Africa, offering a new and critical vision on the situation of asylum-seekers and refugees in the African continent. Cristiano d’Orsi considers the international, regional and domestic legal and institutiona…
