  • Social justice and the judicial interpretation of international equal protection law

    Open Access•Tilmann Altwicker•ARTICLE•Leiden Journal of International Law•2022

Social justice is turning into an international concern. This development is a response to the continuous rise of socioeconomic inequality – the gap between the rich and the poor –growing in several OECD member states since the 1970s. International human rights law (IHRL) presently only establishes a weak normative framework regarding social justice. This article argues that the full potential of this framework has still not been activated by int…

  • Rechts- und Staatsphilosophie bei G.W. Leibniz

  • Non-Universal Arguments under the European Convention on Human Rights

    Open Access•Tilmann Altwicker•ARTICLE•European Journal of International…•2020•Cited by: 2•References: 4

It is popular to view international human rights law as universal. In a normative sense, human rights universality refers to certain qualities of human rights norms. These qualities have long been under attack, most recently by what is called here human rights nationalism. The main point made in this article is that some of the criticism levelled against normative human rights universality can be accommodated through interpretation. To this end, …

  • International Legal Scholarship and the Challenge of Digitalization

    Open Access•Tilmann Altwicker•ARTICLE•Chinese Journal of International…•2019•References: 2

The paper argues that digitalization primarily presents a methodological challenge for international legal scholarship. Three developments are relevant in this context: the datafication of law, computerized information retrieval, and the differentiation of legal knowledge. International legal scholarship has benefited from treating legal texts, legal relationships as well as legal interactions and decision-making “as data”. Typically, quantitativ…

  • International Law in the Best of All Possible Worlds: An Introduction to G.W. Leibniz’s Theory of International Law

    Open Access•Tilmann Altwicker•ARTICLE•European Journal of International…•2019•Cited by: 1•References: 1

Today, the contribution by Gottfried Wilhelm Leibniz (1646–1716), the last ‘universal genius’, to the theory of international law is nearly forgotten. Leibniz was a lawyer by training (later in life holding prestigious positions such as Reichshofrat), and he acted as a diplomat and political advisor to the Duke of Hanover. His engagement with legal practice distinguishes Leibniz from other philosophers. Always looking for intellectual synergies, …

  • Transnationalizing Rights: International Human Rights Law in Cross-Border Contexts

    Open Access•Tilmann Altwicker•ARTICLE•European Journal of International…•2018•Cited by: 2•References: 1

International human rights law (IHRL) is still largely state-centred. This is an obstacle when it comes to making cross-border problems such as transboundary environmental harm and transnational surveillance amenable to human rights claims. The state-centredness of IHRL is challenged by three phenomena associated with transnationalization processes: by extraterritorial harmful effects; by complex (multi-stage, multi-level and public-private) cros…

  • How is Progress Constructed in International Legal Scholarship

Tilmann Altwicker, Oliver Diggelmann•ARTICLE•European Journal of International…•2014•Cited by: 9•References: 4

There is a tendency in international legal discourse to tell the story of international law as a story of progress. 'Progress' is a concept which is tied to the process of secularization and Western 18th and 19th century philosophy. It still inspires the debate on international law – despite all setbacks in 'real history'. This article argues that progress narratives in the international legal discourse are constructed by – more or less subtle – …
