  • Dictionaries in Legal Interpretation as a Time-Sensitive Argument, or on Atemporal and Temporal Justifications

    Open Access•Agnieszka Bielska-Brodziak, Marlena Drapalska-Grochowicz et al.•ARTICLE•International Journal for the…•2026

Time is often an overlooked dimension in legal interpretation. Its passage affects boththe content and the weight of interpretative arguments, making it essential for judges to carefully select the interpretive moment—the point in time to which the interpretation must correspond (e.g., the moment of the crime in criminal law). To investigate judicial awareness of the temporal sensitivity of interpretive arguments, we focus on the dictionary argum…

  • “We are together, but each of us separately.” Friendship as a close legal relationship

    Open Access•Marlena Drapalska-Grochowicz•ARTICLE•International Journal for the…•2024

Friendship is undoubtedly perceived by individuals as a close relationship—based on a special bond and commitment. However, it is a relationship that is very limitedly regulated by the law and is not explicitly labeled as close by legislators. In this study, three research goals were set. The first goal is to determine how friendship is characterized in legal acts, legal literature, and judicial decisions. Marriage, parenthood, or even romantic r…

  • Petrified and Updated, or How the Interpretive Community Exercises Power Over the Meaning of Vague Terms in the Legal Text (on the Example of Polish Criminal Law)

    Open Access•Agnieszka Bielska-Brodziak, Marlena Drapalska-Grochowicz et al.•ARTICLE•International Journal for the…•2024

Interpretation of the law is based on a temporal perspective. The meaning of a legal text changes over time despite the fact that the wording does not change. A provision read in 2019 may be different from the same one read in 2023, even though its letter is the same. While the form is the same, the content may be different, cf. [ 43 ]: 433–436, [ 4 ]: 494–495

  • On why the Court did not want to fight smog, or several comments on the resolution of the Polish Supreme Court on the right to live in a clean environment

    Open Access•Agnieszka Bielska-Brodziak, Marlena Drapalska-Grochowicz et al.•ARTICLE•Ruch Prawniczy Ekonomiczny i…•2023

The authors analyse the 2021 ruling by the Polish Supreme Court, which refused to acknowledge the right to live in a clean environment as a personal interest. The purpose of the paper is not only to evaluate the quality of the Supreme Court’s argumentation, but also to highlight the implicit premises that were missing from the grounds of the decision. Based on these findings, the authors draw broader conclusions about the circumstances that incre…

  • Families of choice with no choice

    Open Access•Marlena Drapalska-Grochowicz•ARTICLE•International Journal of Law…•2023

This article focuses on the situation of families of choice in Polish law. The first research objective was to determine whether and how parenting in families of choice is regulated by law. To achieve this goal, the author analysed appropriate statute and case law, taking into account the sociological and psychological background of family relationships. The second objective was to find legal and non-legal factors affecting the current situation …

  • Uznawanie, niedostrzeganie, ignorowanie. O postawach prawodawcy wobec faktycznej bliskości

    Open Access•Marlena Drapalska-Grochowicz•ARTICLE•Archiwum Filozofii Prawa i…•2021

The text considers why certain types of close relationships are “invisible” in the legal system. Visibility can mean public recognition, status recognition, social acceptance. What is “visible to the law” is the closeness that the law recognizes, accepts, supports, and with which it links certain obligations and rights, e.g. marriage. However, the main subject of this study will be those close relationships that are invisible in the legal system …

  • Where feminists dare

    Open Access•Agnieszka Bielska-Brodziak, Marlena Drapalska-Grochowicz et al.•ARTICLE•Oñati Socio-legal Series•2020

This paper focuses on the public debate in Poland and Italy concerning the right to abortion in the contemporary rise of populist neo-conservative forces in Europe and of a global feminist movement. In both countries, the historical Catholic interference into women's reproductive rights and self-determination has been enforced by the renewed alliance of right-wing governments and pro-life groups to converge into a transnational “anti-gender war”.…

  • Historia zawiedzionych nadziei. O zakazie chowu zwierząt na futra

    Open Access•Agnieszka Bielska-Brodziak, Marlena Drapalska-Grochowicz et al.•ARTICLE•Zoophilologica•2020

The deputy’s draft bill amendment about the Animal Protection Act submitted to the Marshal of the Sejm in November 2017 was one of the most ambitious attempts in the Third Republic of Poland to improve the legal protection of animals. The loudest proposal in the project was to prohibit the rearing and breeding of animals for the purpose of obtaining fur from them. In the article, the Authors reflect on the reasons for the political failure of thi…

  • Prawne interpretacje bliskich relacji człowieka z innymi zwierzątami

    Open Access•Marlena Drapalska-Grochowicz•ARTICLE•Ruch Prawniczy Ekonomiczny i…•2020
