Mirin’ and beyond − gender identity, domestic private international law, and human rights in the EU
This article deals with gender identity and private international law, particularly in cross-border situations within the European Union (EU). It examines how different legal systems handle legal gender determination and change, including binary and non-binary approaches, as well as the conflicts that arise when individuals wish to have their status recognized in another country. A central point is the analysis of the impact of the CJEU’s ‘Mirin’…
Consumers can be deterred from exercising their rights by formidable and complex national rules for proceedings. In her study, Susanne Lilian Gössl shows how German procedural law needs to be adapted to meet EU consumer law requirements.
Legal Gender Beyond the Binary
The article explores the fundamental rights regarding a person’s status registration as neither male nor female and, thus, gender registrations ‘beyond the binary’. The authors analyse the fundamental rights of the individual as codified in the European Convention on Human Rights (ECHR) and examine ‘third options’ in jurisdictions and recent court decisions in Europe. They analyse to what extent similar results might be achieved at the European C…
Anpassung im EU-Kollisionsrecht
The 4th edition of the first volume of this work provides an update of the commentary on the preamble and articles 1 to 19 in case law and literature.
Marriages and Other Unions in Private International Law – Separate but Equal
Many legal systems not only know the concept of marriage but also the one of non-marital registered unions, even though the requirements concerning who can conclude the one or the other union differ, especially regarding the sex of the partners. At the conflict of laws level, most countries show the same approach, i.e. providing two different rules for the validity of each institution. Using the examples of Belgian and the German law, both having…
Italienische Netzverträge (contratti di rete), Niederlassungsfreiheit und anwendbares Recht
There is an ongoing discussion in academia on how to treat the so-called »network contracts« that involve a cooperation between two or more enterprises who jointly want to perform one or more economic activities to increase their innovative capabilities. The participants of the network know of each other. Often, the counterpart's participation is an underlying motive for each side's own participation. Hence, the legal question arises whether the …
