  • Agency costs in third-party litigation finance reconsidered

Brian Fitzpatrick, William Marra•ARTICLE•Theoretical Inquiries in Law•2024

A common criticism of third-party litigation finance is that it can increase agency costs for litigants. One reason critics give for this is their belief that financiers will do something they are prohibited from doing: meddle in the litigant-lawyer relationship. But we think this gets things backwards. Because financiers cannot meddle in the litigation, they try instead to align their interests with the lawyers and the litigants. As we show here…

  • British Imperialism and Australia, 1783–1833

    Brian Fitzpatrick•BOOK•British Imperialism and…•2023

British Imperialism and Australia (1939) looks at the early economic history of Australia, which towards the end of the period under review became an important field of British Imperial development. The establishment of a peasant economy in New South Wales was attempted half a world away from the imperial architects, but war with revolutionary France interrupted the transportation of convicts and poor freemen, and in doing so gave the scheme a ch…

  • The practice and implications of legislative proxy voting in Ukraine

    Erik S Herron, Brian Fitzpatrick et al.•ARTICLE•Post-Soviet Affairs•2018•References: 17

Governing parties often face the challenge of coordinating the behavior of legislators to pass bills and achieve their policy goals. Solutions to this collective action problem vary, but generally involve a combination of inducements and punishments to encourage legislators to toe the party line. “Ghost voting,” a form of proxy voting in which legislators record roll-call votes in place of their absent co-partisans has been noted over time in man…

  • Catholic Royalism in the Department of the Gard 1814–1852

    Open Access•Brian Fitzpatrick•BOOK•Catholic Royalism in the…•1983

The Gard in southern France was the scene of extensive bloodshed in 1790, when opponents of the Revolution tried unsuccessfully to prevent change, and again in 1815, when they sought revenge through a carefully prepared White Terror. The revolutions of 1830 and 1848 also provoked violent conflict in the Gard, and even when the department appeared to enjoy tranquillity, political and social relations there were soured by intimidation and fear. Thi…

Nearly 120 years have passed since the New South Wales magnate Ben Boyd started in 1847 the traffic in Pacific islanders' lives and labour which gives this lucid, absorbing and scholarly book its title; more than one hundred years since in 1863 the eminent Captain Robert Towns, M.L.C. (N.S.W.), shipowner, merchant and plantation owner, 'recruited' the first of more than 60,000 islanders blackbirded, cajoled or otherwise contracted on to plantatio…
