  • In a World of Their Own

Open Access•John D Jackson, Jonathan Jackson•ARTICLE•Journal of Law and Society•2019

This article charts how security‐cleared counsel have been constructed as a mechanism for managing the tension between security and fairness in secret trials and transferred across national boundaries as an example of ‘best practice', before going on to evaluate recent cross‐cultural and transnational research on this ‘best practice'. Particular attention is paid to the central role played by the European Court of Human Rights (ECtHR) in promotin…

  • Responses to Salduz

    Open Access•John D Jackson•ARTICLE•Modern Law Review•2016

This article examines the responses of national courts to the ECtHR's decision in Salduz v Turkey that suspects be provided with access to a lawyer before they are first interrogated by the police. It argues that harmonious application of human rights standards in criminal proceedings should build upon common values underpinning the procedural traditions of member states. ECtHR success in gaining acceptance for the principle of access to a lawyer…

  • Witness Preparation in the ICC

    Open Access•John D Jackson, Jonathan Jackson et al.•ARTICLE•Journal of International Criminal…•2015•Cited by: 1•References: 1

In January 2013 Trial Chamber V of the International Criminal Court (ICC) in the cases of Samuel Ruto, Francis Muthaura and Uhuru Kenyatta, collectively known as the 'Kenya decisions', made a marked departure from the firm prohibition on 'witness proofing' declared by Pre-Trial and Trial Chamber I in the Lubanga decisions. This reversal illustrates the polarisation of an issue that has caused considerable controversy in the international legal co…

There are a number of important problems in contemporary museum finance, and this article identifies yet another possible difficulty. An aggregate statistical measure of museum attendance is calculated in this research and the attendance measure is shown to be countercyclical in nature. When set against federal and other allocations to museums, which are clearly pro-cyclical in nature, an attendance "disease" may be at least tentatively identifie…

  • Do Casinos Cause Economic Growth

    Open Access•Douglas M Walker, John D Jackson•ARTICLE•American Journal of Economics and…•2007•Cited by: 3•References: 20

Casino gambling is a popular form of entertainment and is purported to have positive effects on host economies. The industry surely affects local labor markets and tax revenues. However, there has been little evidence on the effects of casino gambling on state economic growth. This paper examines that relationship using Granger-causality analysis modified for use with panel data. Our results indicate that there is no Granger-causal relationship b…

  • The Effect of Human Rights on Criminal Evidentiary Processes

    Open Access•John D Jackson•ARTICLE•Modern Law Review•2005•Cited by: 2

This article examines the contribution which the European Court of Human Rights has made to the development of common evidentiary processes across the common law and civil law systems of criminal procedure in Europe. It is argued that the continuing use of terms such as ‘adversarial’ and ‘inquisitorial’ to describe models of criminal proof and procedure has obscured the genuinely transformative nature of the Court's jurisprudence. It is shown tha…

  • Justice for All

    Open Access•John D Jackson, Jonathan Jackson•ARTICLE•Journal of Law and Society•2003•Cited by: 2

This article considers the claim in the government's White Paper, Justice for All , to put victims and witnesses at the heart of the criminal justice system and argues that there is an unresolved tension within the paper between instrumentalist crime control concerns and intrinsic concerns for the rights of victims and witnesses. It is argued that many of the proposals now contained in the latest Criminal Justice Bill are so preoccupied with reba…

John D Jackson, Jonathan Jackson•ARTICLE•Canadian Journal of Communication•2001

Canadian audiovisual production in film or video, on tape or CD are in danger of deteriorating and, what is available, of becoming inaccessible. This was the conclusion of a Federal Task Force report titled Fading Away in 1995. The problem is all the greater six years later. Apart from the loss of a valuable heritage, the lack of support for the preservation of and access to audiovisual production is detrimental to major research interests in com…

It crosses the boundaries of public and private, non-profit and for-profit, neutral and value-laden, and secular and religious. This book explains the origins of this unequivocally unique pluralistic system. The Dutch broadcasting system is also one of many other pluralist social, economic, and political structures that wer…

This is a full-length study of a major figure of postwar French intellectual life, who was a champion of socialist humanism. While many Parisian leftists staunchly upheld Marxism in the 1950s and 1960s, Lucien Goldmann insisted that Marxism was by then in severe crisis and had to reinvent itself radically in order to survive. He rejected the traditional Marxist view of the proletariat and contested the and antihumanist theorizing that infected Fr…

Over the past decade, cultural analytic methodology has changed and developed such that erstwhile favoured formalism has been replaced by structuralist and poststructuralist methods. These changes have expanded to a considerable degree the scope of interpretation. No longer do we simply see the text or the image as the whole, self-contained object. No longer is the author or the artist considered a transcendent self or bearer of meaning. Rather, …
