  • A Dangerous Metaphor: Thoughts on the Dysfunctionality of the Notion of a “Public-Private Divide”

    Michael W Dowdle•ARTICLE•Law & Ethics of Human Rights•2024

This article argues that the notion that state and religion should be strictly separated, resulting in a condition that is often captured by the metaphor of the “public-private divide,” is both unfounded and dangerous. It is unfounded in the sense that at least in modern functional democracies, the state and religion are not actually separated but are in fact constantly interacting and affecting one another. It is dangerous in the sense that if c…

  • Constitutionalism beyond Liberalism

    Open Access•Michael W Dowdle, Michael A Wilkinson•BOOK•Constitutionalism Beyond Liberalism•2017

Constitutionalism Beyond Liberalism bridges the gap between comparative constitutional law and constitutional theory. The volume uses the constitutional experience of countries in the global South - China, India, South Africa, Pakistan, Indonesia, and Malaysia - to transcend the liberal conceptions of constitutionalism that currently dominate contemporary comparative constitutional discourse. The alternative conceptions examined include political…

    Open Access•Michael W Dowdle, Michael Dowdle•ARTICLE•Revista Direito e Práxis•2016

DOI: 10.12957/dep.2016.26505 Abstract Market regulation is generally regarded as a technocratic exercise, one which consists of ensuring that the rules and practices of market being regulated correspond as much as possible to those of an objective ideal-type often referred to as a 'perfect' market. The institutional manifestation of this believe is the 'independent regulatory agency', a particular kind of market regulator which is supposed to be …

  • Deconstructing Graeme: Observations on "pragmatic psychology," forensics and the institutional epistemology of the courts

    Michael W Dowdle•ARTICLE•Psychology Public Policy and Law•2003•Cited by: 1

Daniel Fishman's paradigm of pragmatic psychology seeks to mediate the culture wars between proponents of scientific approaches to psychology and proponents of postmodern approaches to psychology by constructing an epistemological framework that is serviceable to both kinds of approaches. The courts' position within the larger constitutional order severely limits their capacity to deploy the postmodernist aspect of pragmatic psychology. On the ot…

  • Heretical Laments: China and the Fallacies of ‘Rule of Law

    Open Access•Michael W Dowdle•ARTICLE•Cultural Dynamics•1999•Cited by: 1•References: 22

While the general consensus is that there is no real rule of law in China, we actually have a great deal of difficulty explaining why. This article seeks to show that none of the arguments commonly advanced as to why there is no rule of law in China are particularly compelling. Some critiques claim that China's rule-of-law insufficiencies are due to deficiencies in her conceptualization of law. But these critiques either depend on false conflatio…
