Fraud, needs, and gender discrimination in pre-nuptial agreements
More than 15 years after the Supreme Court decided that pre-nuptial agreements would be given effect unless unfair in Radmacher v Granatino [2010] UKSC 42, questions remain as to when it would be unfair to uphold an agreement’s terms. The issue of disclosure, however, is relatively settled. As the Supreme Court clarified in Radmacher, the court must ask whether there was any ‘material lack of disclosure’ depriving a party of ‘all the information …
Child Preparedness for Infertility Disclosure
Infertility, often perceived as an adult issue, can also manifest in childhood, presenting unique challenges. Improper handling of infertility disclosures can strain parent–child relationships and potentially lead to significant psychological distress, including depression, anxiety, and long-term impacts on self-image. Despite the critical nature of these conversations, parents often report receiving little or no guidance from professionals on ho…
Unreported nuptial agreements in England and Wales
Pre-nuptial agreements are not binding under legislation in England and Wales but can have decisive weight on divorce provided they are not unfair. Pressure is mounting for reform, because it is not always clear when the court will determine when an agreement is unfair. However, circumspection is needed before introducing legislation that would make such agreements binding. There are gaps in what we know about pre- and post-nuptial agreements on …

Edith Summerskill
While Edith Summerskill was an important feminist reformer of the twentieth century, she remains an arcane figure in the history of the Labour Party and is a mere footnote in family law history. Yet she has played a significant, albeit unacknowledged role in law reform, particularly through her campaigns for greater legal protection of married women. Summerskill’s relegation to the margins of family law, and in particular the understated signific…
Sex and Socialism
While later generations of Marxian scientific socialists saw sex as secondary, derivative of the real relationships of production, many of the earliest socialist theorists and movements took sexual matters very seriously. Thus, in many ways, the advent of Marxian socialism represented something of a step backward in the development of a radical sexual politics. However, in the twentieth century, old divisions on the sex question within the left s…

A millstone around the neck? Stereotypes about wives and myths about divorce
This article examines the effect of and connection between stereotypes about wives and myths about financial provision on divorce. It is based on an assessment of press reports on Mills v Mills which have fuelled calls for reform of the law of financial provision on divorce, most notably the Divorce (Financial Provision) Bill 2017–2019. It argues that gendered stereotypes about wives (such as ‘alimony drone’, ‘gold-digger’ and ‘meal ticket for li…

The Sexual Contract 30 Years on
This reflection is based on a conversation with Professor Carole Pateman on 4th December 2017 as we prepared for a conference at Cardiff University to celebrate the thirtieth anniversary of her seminal work, The Sexual Contract (1988). As socio-legal scholars, The Sexual Contract has been formative in, and transformative of, our understandings of law and gender. We explore Professor Pateman’s academic journey and consider how she came to write a …
Feminist Relational Contract Theory
In this article, a new model named Feminist Relational Contract Theory (FRCT) is explained, justified, and applied to the context of family property agreements and specifically nuptial agreements. Most nuptial agreements are created amidst a complex web of power relationships and the dynamic of these relationships often evolves over time. However, the courts in England and Wales have not yet found a way to recognize this without adopting a patern…

Relational Autonomy and Religious Tribunals
Academic writing on the place and status of religious tribunals in western societies has focused upon the ‘minorities within minorities’ debate: the extent to which States should intervene to ensure that the citizenship rights of female group members are protected and that religious tribunals do not discriminate on grounds of sex. In a number of recent publications following the Cardiff research on Social Cohesion and Civil Law: Marriage, Divorce…

Radmacher (formerly Granatino) v Granatino [2010] UKSC 42
This paper examines the Supreme Court decision Radmacher v Granatino. It will assess the impact of this case on the position of ante-nuptial agreements in England and Wales. It will also consider the significance of Lady Hale’s dissent, which raises some important social concerns connected to the enforcement of ante-nuptial agreements

Development of the Intimate Partner Violence Attitude Scales (Ipvas) With a Predominantly Mexican American College Sample
Although instruments that estimate the prevalence of intimate partner violence (IPV) are available, few include potential predictors of violent behaviors such as beliefs and attitudes. The main purpose of this study was to develop a measure of attitudes toward various forms of IPV. The secondary purpose was to examine Mexican American and non-Hispanic White college students’ attitudes toward IPV. Data from a sample of 333 predominantly Mexican Am…
Subversive political praxis
This paper is drawn from research conducted with gay and bisexual men with learning difficulties, a project that included participants' various struggles to self-identify within these alternative sexualities. Significant parts of this identity work were mitigated by participation in what is referred to here as ‘politically radical support groups’. Three facilitators of these groups, professionals in the areas of sex education, were interviewed an…

Putting a big thing into a little hole
The rise in adolescent coitus in the late 1970s and early 1980s provoked many studies of teenage contraceptive practice. Drawing on 400 in‐depth interviews with teenage girls, this article considers the quality of teenage girls’ sexual initiations, comparing the family and sexual histories of girls who describe sexual initiation as painful, boring, or disappointing with those of girls who emphasize sexual curiosity, desire, and pleasure. In concl…
