Towards a cartography of small-scale property grabbing: The case of Mexico City
Vicente Moctezuma (2021).
Landscapes of dispossession: Criminal justice and property rights in Mexico (2015–2020)
It is generally accepted that the State plays an important role in promoting and facilitating practices of dispossession; yet there is little reflection on its role in prevention, processing, and reversion (restitution). Our research focusses on dispossession understood as a crime. The criminal classification of dispossession as well as the continued reporting of its frequency and magnitude, suggest that crucial State institutions, such as those …
Criminal justice reform and court-imposed bail in Mexico: An Empirical Report
This article furthers the discussion on bail through an analysis of the conditions under which this measure is used in Mexico, a country which has recently reformed its penal system (2008–2016) by introducing new procedural rules, which seek to reduce the use of pretrial detention. The study is based on a statistical-descriptive examination of 1,537 judicial cases in which judges chose to impose either pretrial detention or bail. Our findings ind…
No life, no land: Homicide and dispossession in Mexico
War on Drugs, War on Women: Visualizing Female Homicide in Mexico
Recent literature has established that War on Drug policies lead to differentiated consequences over the lives of certain groups within the population when analyzed by race, gender, age, and/or social status. In particular is the relationship between the War on Drugs and its effects on women. The objective of this article is to analyze the asymmetric behavior of homicidal victimization between males and females that has unfolded since the beginni…
(Un)Authorized: A Study on the Regulation of Street Vending in Latin America
This article offers an examination of the official rules that participate in the organization of street vending activities in Latin American cities. It does so by explaining the legal assemblages that serve to define how, where, and by whom certain Latin American public spaces may be occupied, and by empirically illustrating the way in which the legal status of street vendors—that is, whether or not they are willing or able to get official recogn…
Is cheaper better? Public and private lawyers before criminal courts in Mexico City
This paper aims to conduct a descriptive analysis of a total of 2,172 semi-structured interviews with sentenced inmates in Mexico City during 2002–2008 in order to explain how public legal defence works, how this service is evaluated by the inmates who took part in the interviews, and how the traditional division between public and private services constitutes an important distinction in the way in which criminals interact with, and are processed…
Law and Mobility: Ethnographical Accounts of the Regulation of the Segregated Cycle Facilities in Mexico City
This paper seeks to explain the operation of and the reactions to the everyday regulation of the segregated cycling facilities in Mexico City. Specifically, through an ethnographic approach, this paper tries to illustrate how social practices, everyday legal interpretations, and police practices intersect so as to reinforce the preeminence of the automobile at the expense of other forms of mobility, such as cycling. This question is essential in …
The Everyday Formation of the Urban Space: Law and Poverty in Mexico City
Crime, Street Vendors and the Historical Downtown in Post-Giuliani Mexico City
This article endeavors to go deeply into the recent transformations that have taken place in the regulation of street-level economic and business activities in Mexico City. It draws upon data collected during the course of a three-year research project carried out from 2007 to 2009, a specific timeframe when the urban authority deployed different legal and repressive strategies in order to ‘clean-up’ the streets of the city’s downtown areas, in k…
The right to work on the street: Public space and constitutional rights
Do people have a right to work on the street? If so, what are the constraints and conditions attached to this right? Historically, municipal authorities have tried several ways to regulate or even prohibit commerce on the streets, by implementing administrative regulation and criminal laws, but neither has proven successful thus far. In fact, in some cases, these attempts have backfired. Constitutional challenges to municipal regulations have pav…
Out of Place, Still in Motion: Shaping (Im)Mobility Through Urban Regulation
Historically, in Mexico City, people who conduct trade on the streets have been engaged with a highly regulated world of spatial restrictions, fines and detentions, still they remain on the streets. This article explores how the regulation of street-vending activities has contributed to the constitution of an ideal hierarchy of would-be social agents in public spaces by consecrating the distinction between authorized and unauthorized street users…
