Response to Koh and Buchwald’s Article: Don Quixote and Sancho Panza Tilt at Windmills
In their eagerness to justify the “United States perspective” on the Kampala definition of the crime of aggression and on the International Criminal Court (ICC), Koh and Buchwald tend to invent imaginary enemies and to ascribe to them views that they do not actually hold. The ILC Guide to Practice on Reservations to Treaties: A General Presentation by the Special Rapporteur
The purpose of this article is to revisit the long saga of the ILC Guide to Practice on Reservations to Treaties, as the Special Rapporteur has lived it for nearly 18 years and 16 reports. In its first part, the article recounts the elaboration procedure, pointing in particular to the elements of innovation and flexibility introduced in the process. The main one is the very type of instrument adopted, namely a Guide to Practice, and not a set of …

The Declaration made by the Palestinian Authority on 21 January 2009 whereby Palestine agrees to the exercise of jurisdiction by the International Criminal Court for crimes committed in Palestinian territory since 1 July 2002, raises several interesting issues of international law. However, according to the author, the Court must not engage with all such issues, which are indeed extremely broad in scope; in particular, the Court should refrain fr…
